Is NOC required from private software company for higher education in regular mode if time doesn't match for office and college.

You may have to obtain permission from your employer for pursuing the higher education on the basis of  your assurance that your pursuance of higher education would not hamper the employment.

The company may grant you permission subject to service exigencies.

Definitely if times did not match then it is very difficult for you to continue both.  Please see that your company adjust comfortable timings which didn't clash with regular timings of your proposed course.

If you want to obtain a degree and the timings do not match you shall have to obtain the noc as you would be attending classes and writing exams. Therefore prior intimation would be a good step.

it is not mandatory to get NOC to join any education course. Any activity other than not intented for money, nor  consuming the office hours would not require any NOC.

In case you are in full time job and you are joining any Educational Institute then definitely you have to go for NOC from your organisation that you will be joining your education and in case there is a time mismatch then the organisation should provide relaxation in working hours so that you can attend the institution during those hours the institute must make sure that your availability in the institute during your working hours by no objection certificate from the organisation

  1. As per the information mentioned in the present query, makes it clear that you have been thinking of going for the higher study and may have some good opportunity also for the same.
  2. Yes, if time doesn’t match then you may have to talk with the company to allow you to go for the higher study by making some arrangement in respect for eh timing of the work. Though, there is no compulsion for NOC, if not been asked as one of the per-requisite condition by company or college.
  3. Otherwise, if time is not the constraint and there is no such binding in employment agreement for thinking about the higher study then you may not need even NOC from the company.

1. It is not required as company cannot claim to possess any discretion to decide whether any employee should pursue higher education.

2. If due to the higher education pursued by the employee his regular course of employment is affected then he can be terminated.
