Mujhe meri pustaini jamin vidhiwat tarike se batware me mili thi. Jamin 2 prakar ke they residential aur commercial Ishliye batware me 2no ko kuch residential aur commercial bhi mila. Aaj se 20 sal pahle hamne commercial(80 decimal) me se 5-5 decimal beach diya.

Magar kuch sal pahle mere bhai ne mere commercial jamin ko apna bana liya aur ushme kabja kar colony bana liya magar wo abhi ushko bech nahi paya hai.

Ishke bad hamne tehsilidar, sdm se stay ke liye appeal kiya magar unhone kharij kar diya kyunki ushne RI/Patwari ko set kiya hua hai aur report me likhte hain ki(kabja sahi hai aur wo apne jamin me hi kam kar rahe hain).

Kahin se relief nahi mila to hamne high court me stay ke liye apply kiya.

Aur hame stay mila (My I/A has been allowed by Judge , it means stay will be on Khasra no 74/3
but some mistake in order stey given on 74/1/3
So pls tell me how we will get remedy ?) aur SDM ka kehna aapko 74/1/3 me mila hai na ki 74/3 me.

You have to file precipe for production of case papers for speaking to minutes of order

court would pass orders on same date only to rectify mistake in order

If there is an error in the orders passed by the court, you may point it out by filing a petition before the same court mentioning the error and seek rectification of the order by quoting correct survey number.

The court, after verifying the records and details of the orders passed, may rectify the same and you can get the certified copy of the same for all future purposes.

Modification of the order may not take much time, however you can seek an interim injunction restraining the respondent from alienating the property in any manner till the disposal of the modification application as an interim relief.

You can approach court with anther application for this.

Since there is a typographical error in the description of the property set out in the order passed by the High Court the remedy in your hands is to file an application for rectification of that error in the High Court. File the application tomorrow.
