1) you would be governed by provisions of Indian contract act

2)if you have signed agreement to avail holiday package you would be bound by terms of contract

3) if you cancel your booking refund would be governed by provisions of contract

4) there would be refund clause that in event of cancellation of booking x amount would be deducted as cancellation charges

Dear Client,

Such industries come sunder department of tourism. Whatever packages offered by company shall be accompanied by terms and condition. And in most cases where costumer himself withdraw from package, company deducts some % of amount and rest refunded or no refund, all permissible depends on terms of company.

hello,

Kindly tell the facts in detail . From what you have told, the following is my opinion but not concrete

If in the agreement between the company and the customer there is a clause that there will be no refund then the customer does not have any right.

Consumer protection act will apply in your case.

If there is a fault on your part due to which the customer is not availing the services then he can file the case in the district consumer forum,

Hotel industry consists of restaurants, lodging places, theme parks, event planning, etc. and includes activities such as facility maintenance and direct operations including servers, porters, housekeepers, bartenders, kitchen keepers, etc. Such services that are provided by the hotels constitute to be the subject matter of laws that regulate the hotel industry.

There is no specific law regulating Holiday package, it all depends on the terms and conditions between the tour operators and the tourists.

The consumer can find relief in the terms and conditions itself for refund and other issues
