Kerala HC makes it mandatory for all Government staffs and officers to attend National day functions

Kerala HC held that The Independence Day is one of the most significant day in the Indian history. After a freedom struggle of almost 100 years, India could attain freedom and to commemorate the above day it is declared as national holiday. Similarly, 26 th January is another significant day for the country on which day the people of India have resolved to constitute India as a sovereign democratic republic on which day the constituent assembly adopted, enacted and gave to the people of India, the Constitution of India.”

Attending national day functions, a fundamental duty

The bench said that one of the fundamental duties, according to the Constitution, is to “cherish and follow the noble ideals which inspired our national struggle for freedom”. What else can be most important days than the above national days to cherish the noble ideals which inspired our national struggle for freedom? The above fundamental duty is cast upon every citizen of India. We are thus of the view that participation in the national day celebrations is expected not only from the Government servant and other public servant, local authorities, institutions, but it should be a spirit of every citizen of India to participate and cherish the memory of above important days in the history of India,

Hi,

The flag hoisting is towards pride and honour towards nation and motherland. You may attend it at other places also but you should not ignore your own organisation for any reason whatsoever.

Dear Client,

It is not mandatory but obligatory on employees to celebrate the day on their work premises. Which is more incumbent on higher authorities. IF no specif orders to attend the hosting ceremony, your are independent to celebrate from any place.

1)There is no rule which says that it is compulsory for a government employee to attend Flag hosting on republic and independence days.

2) Attendance on independence celebrations cannot be made compulsory whereas it is to be brought out as a matter of national spirit. It should come within the hearts of each and every citizen of India rather than making India a piece for glory and pride only when Indian cricket team is on the field. When independence celebrations are also being sponsored by foreign companies, I don't think that any body can mark ones absence as "absent" and will the HRMS support it!

Hello,

It is not mandatory to attend the flag hoisting ceremony.

However, if the instruction or some invitation to this effect has been given to you then it is advised that you attend the same, unless and until there is some grave urgency.

Dear Sir,

Take permission of the your Head of the department to attend such function at any other PSU or govt. organisation and promise to produce attendance certificate for having attended.  If such permission is granted you can avail the same.  Such permission will normally granted on valid grounds cited by you.
