My marriage was happened in kerala, India and duly registered and received the marriage certificate. 

my wife wanted to settle down in India, So please let me know the procedure for taking spouse visa for her further stay in India.

Dear Client,

Entry Visa is issued to Foreign Spouses of Indian Nationals. The visitors are required to fill online visa Application by visiting website http://indianvisaonline.gov.in/visa/ and visit their nearest embassy with printout of the online filled application and required travel documents.

And she will get citizenship by registration as married to a citizen of India and is ordinarily resident in India for seven years.

                               ENTRY (‘X’) VISA

An Entry (‘X’) Visa may be granted to a foreigner in the following cases :-


(1) A Person of Indian Origin, who do not possess an OCI card, and may be granted ‘X-1’ Visa for a period of five years at a time, with multiple entry facility.

(2) Spouse and children of an Indian citizen/ Person of Indian Origin/ OCI cardholder (other than those who are registered as OCI cardholder) may be granted ‘X-2’ visa for a period of five years at a time, with multiple entry facility.

Note
(i) After completion of 5 years from the date of issue of X-1/ X-2 visa , if further extension is required, the proposal shall be referred by FRRO/ FRO concerned to the Ministry of Home Affairs for clearance. MHA would grant extension for one year after the expiry of the initial period of five years. Subsequent extensions, if any, up to a total period of another 5 years at a time may be granted by FRROs/FROs concerned. The same procedure will be adopted if further extension is required.

(ii) A “Person of Indian Origin” means - (a) a person who at any time held an Indian passport;

or (b) a person who or either of his / her parents or grand parents or great grand parents, was born in , and was permanently resident in India, provided neither was at any time a citizen of Afghanistan, Bangladesh, China, Pakistan or Sri Lanka or any other country that may be specified by the Government of India from time to time.

 

 

Regularization of stay of foreign nationals married to Indian nationals


FRROs/ FROs are delegated powers to regularize the stay of foreigners who had entered India on Tourist Visa and have been staying in India for many years due to marriage to Indian nationals,convert their visas to Entry (X-2) visa and grant further extension of visa on case to case basis.

See a dependent visa can be applied at this stage.for.your wife based on the fact that she is married to Indian man . Based on the same she will get visa and after a period when she is eligible after stay in India she can apply for citizenship. You need to make an application to MHA for X entery visa which is for resident visa.

You can apply a long-term is sponsored visa for your wife and she can stay in India for a longer period after 7 year of his Day in India you can go for neutralization and C can get the citizenship of India on neutralization.

Please be aware that the children born in this period will automatically be Indian national and there will be no need of any citizenship application

As after marriage, she tends to get the VISA of India you just need to make an online application to Ministry of External Affairs and lifetime VISA.

So, you've fallen in love with an Indian citizen and gotten married in India on a Tourist Visa. What happens next? How do you convert your Tourist Visa to an X Visa so you can stay in India? The good news is that it can be done without leaving India. The bad news is that the process is quite time consuming. Here's how to do it.

After Two Years: Applying for an OCI Card

It's not possible to apply for Indian citizenship unless you've been living in India for at least seven years (and for anyone who comes from a more developed country, it's not an attractive option anyway due to the restrictions that come with having an Indian passport). The next best thing is an OCI (Overseas Citizen of India) Card, which grants working rights along with most other rights of an Indian citizen (except voting and buying agricultural land). It has lifetime validity and does not require the holder to be registered with the FRRO.

As its name suggests, the OCI card is usually for people of Indian origin. However, anyone married to an Indian citizen or person of Indian origin is also entitled to it (as long as they don't have any heritage from countries such as Pakistan and Bangladesh).

You can apply for an OCI card in India after two years of marriage if you're on a long term visa (of a year or more) and registered with a FRRO. FRROs in major capital cities have the authority to process applications. Otherwise, all applications must be sent to the MHA in Delhi.
