• Is NATP necessary for sale deed

After the death of grandmother, for doing the saledeed in her legal heirs names we have issued legal heir certificate. But now Subregistrar says that unless NATP is not done saledeed cannot be done.And in agreement of sale it is mentioned that Townplanning is supposed to be done by the person from whom grandmother has purchased plot and it is also mentioned that industrial NA is done. So, is there any such rule that saledeed can't be done without townplanning.

It depends on the nature of property that is being sold now.

In my opinion the registrar has no concern with the conversion of NA or not provided if there is no restriction by an order of the government to register the property of such nature without any such conversion.

You may enquire the local rules and proceed whichever is viable.

Issue a legal notice to the seller if he fails to convert the land or pay charges for same file a suit for specific performance in pursuant to the agreement.

What was the promise made by the seller in this regard at the time of selling the property?

If he had agreed to get the property NA converted then you may issue a legal notice to him demanding completion of the said task.

If he is not complying with the demand made you may file a suit for specific relief seeking direction of court to him to get the proper approval from concerned authorities and execute the registered sale deed.
