On contacting the ex- spouse, that party is not willing to share the document or any details with me. I really need the document. Please help.
You can get the decree through name also. Find the details vide computer section of family court you will get the same
This divorce was in the year 2000. That time there was no computerization. What would be the way then. Thanks
Hi,
In which city you belongs kindly provide city court name and your name and spouse name in this case who was applicant and responded etc.
1) you can contact your lawyer who filed petition for divorce on your behalf
2) lawyers retain copy of divorce decree for their record
Contact the Advocate who handled your divorce to see if he has a copy of the decree. If your Advocate is deceased or retired, he may have given his records to another Advocate in the practice. If so, contact that Advocate to see if he has your records.
1. Send a RTI application to curt seeking necessary information with available information you hvae.
2. There is a filing register in every court which is maintained even today. So from the filing register it is not so difficult to get this information.
Sir you need to get certified copy of document from.the court for that you need case number based on that only they can search in disposed of cases. Further you can engage an lower court advocate he can take help of local staff to search name wife in year of filing to search case no.
Yes sir in 2000 there was no computers it has.to be physically searched and family court staff can only help give them some motivation they will search for you.
If yes then the same can be tracked manually.
also if you remember any date of the divorce proceedings then the same will be beneficial.
regards
Dear Querist
if the divorce was granted by the Court in Delhi/NCR then you can contact to me for assistance.
Engage a local lawyer in the concerned family Court to inspect the relevant records for the year 2000 and pull out your case details.
Try locating the relevant details of yourcase/order by visiting https://services.ecourts.gov.in
You need to approach to the staff of the family court they can only help you during the year 2000 day was no computerization show all the records maintained manually. Legal it is not possible to get the document without the proper date and year
1. In which court, the said decree of divorce was passed?
2. If it was passed in India, then engage a local law clerk who will arrange to get information about the said case against receipt of money.
3. Since it had taken place before 18 years, some one at the Court shall have to enterv in to the record room and search for the said record which he will do only after receiving good amount of payment.
1. The record is there for sure.
2. The record has been kept in the record room where in old records are kept and there must be lots of dust accumulated in the said 18 year old record.
3. The peon of the Court shall have to take initiative to trace the said record from the record room which he will do only after getting his palm well greased.
Without proper details you cannot locate the records that too as old as18 years.
To my knowledge without proper details no records can be traced because there were no computerized records maintained then.
However you contact any local advocate who sometimes may be able to trace it by permutation and combination method.
