the mother is the owner of the property which is jointly owned but she has a share in it. she can gift her share in the property to the son. a gift to the son does not require stamp duty.

She can transfer her inherited share, you have to give application to the concerned tahsildar & talathi with a copy of sale deed attached to it.Then mutation entry regarding your ownership of said plot will be taken in 7/12 extract of land.

Mother has absoulte liberty to gift her share to any one. Stamp Duty - three per cent of the market value of a property/her share.
If the same is ancestral property all children will be the lega heirs along with mother, If property is slef acquired then she will decide whom she wants to give.
