• Gift Deed by mother to her son of undivided share in agricultural land in Maharashtra

Can mother having name on 7/12 extract, who is joint owner in agricultural land which is not divided, make gift to her son through. Land is situated in Maharashtra? Whether consent of other joint owners will be required? What will be stamp duty when such gift deed is registered?

yes can be done provided the donee should be an agriculturist

The gift deed for agricultural land in blood relatives attract stamp duty of Rs 200/- only.

hello

the mother is the owner of the property which is jointly owned but she has a share in it. she can gift her share in the property to the son. a gift to the son does not require stamp duty.

She can transfer her inherited share, you have to give application to the concerned tahsildar & talathi with a copy of sale deed attached to it.Then mutation entry regarding your ownership of said plot will be taken in 7/12 extract of land.

Yes the consent of the oother joint owner will be requird. Otherwise by means of the gift deed she may just tranfer ger title to you and in the deed no specific area of the land will be mentioned. 

the stamp duty can be better told to you by a local advocate.

1. The owner of the undivided and undemarcated land can be gifted by registering the gift deed in favour of anybody he/she feels like including her/his son.

 

2. No consent from the other co-title holders of the said property is required to be taken when the gift deed is registered in favour of her son.

The mother can execute a registered gift deed in respect of her undivided share in the jointly held property.
