If OC or completion certificate is provided by PMC, than its not problematic at all.
If plan is sanctioned by grampanchayat for 5 storey and town planning sanctioned plan for 4 storey is it beneficial to buy flat on 5th floor. Now that area is under Pune municipal corporation. Whether 5th foor will be approved by municipal corporation.

2. Or part OC has been obtained?
3. Nonetheless it is not a smart choice to purchase such a flat on the 5th floor;
4. You can go ahead with the purchase if the builder gives you an indemnity bond;
5. Still consult a local lawyer and take steps.
Sir whether the CC is received or not if the construction is complete. If there is issue in jurisdiction of authorities and total plans are not approved and OC is not received I would not advise to purchase same.
Since as on date the 5th floor is not regularised, it is not advisable to buy a flat on the 5th floor.

Check first whether area comes under Municipal area limits at Municipal office.
if it is not coming under municipal limits, then gram panchayat approval is valid.

Town planning department has authority over grampanchayat. So 5th floor will not be regularized by them. Dont buy 5th floor.
1. Grampanchayat has no legal jurisdiction to Sanction /Approve plans. It is illegal.
2. Only the Town Planning dept., or the local Municipal authorities can Sanction /Approve plans.
