• Brother giving threat to kill himself

Dear Sir,
 I am Himanshu shah staying in Malad (West), Mumbai, India. I have joint property with my brother. We have an oral agreement that he will go out of house for 06 months then I will go for next 6 months + he will bear all expenses of my father's medicine, but he had not fulfilled his promised. So I rejected that I will not vacant my flat as even I am also co owner of the flat.

Now he is giving me threat in writing that he will go on hunger strike & kill himself on 28.11.2018 in our joint flat.

What should I do. Do I register a police complaint.

Please guide me.

Yes file a police complaint that the brother is intimidating you to kill himself or you for taking over flat illegally .

Lodge an FIR and let police peruse the case in such situation it is always better to inform.on time.

Further if it is joint flat file for partition of same.

You may file an informatory petition u/s 39 of the crpc in which you can inform the local jurisdictional police station and to the Court concern. .

1. If he has already said that and you have proof of the same then file a police complaint;

2. Because in the off-chance if he does that or even attempts the police can come hunting for you;

3. So do not let the civil matter turn into a criminal one;

1. An oral agreement has no force of law and does not result in crystallisation of any rights.

2. Since he has made a threat of suicide in writing you should send an intimation to the jurisdictional police station and also Commissioner/Superintendent of Police of your city and also annex a copy of his written threat. No FIR will be registered against your brother but it will create a safety valve for you.

1. File complaint immediately to the local concerned police station that your brother is giving you life threats to commit suicide and show them records whatever recorded through his phone calls.

2. As per section 39 of crpc in which you can inform the concerned station house.

3.if you cannot go to the police station you can send rpad through concerned station. The authority will take necessary action

4. Do not let him criminal matter to be turned as civil suit

5. Consult immediately a local lawyer and take necessary steps.

If you are the co-owner of the flat then you may issue a legal notice to him seeking partition and separate possession of your share in it, if there is no improvement in his behavior even after this, then you may file a partition suit to put more pressure on him.

If he continues to threaten with suicidal threats, you may lodge a complaint with the police on this.
