• Construction of permanent meter box on boundary wall

Sir/Madam,
My neighbor has constructed his meter box on boundary wall i.e boundary wall servers as one wall of his meter box. As much as I know one has two leave 3 mts. from boundary wall to make any construction.He refuses to acknowledge this and reasons that since it his boundary wall i.e inside his space he can construct anything on the wall.
Please guide me on this matter whether I am correct regarding the issue.

Hi, it is advisable to file a civil suit for permanent injuction and obtain a stay order restraining him from doing such act

before any construction fixing you can file suit for Injunction in the competent court and asking the Hon'ble court to maintain Status Quo the property till the adjudication.

1. Constructing a very small civil enclosure for a essential statutory requirement (electrical meter box/room), would not fall under the FSI category and no permission would be required from the civic body and neither it would constitute any prosecutable offence. The Three meter restriction from the Compound wall is for civil constructions consuming permissible FSI.

2. HOWEVER, "IF" the said meter room is encroached upon your side of the property, THEN it constitutes a criminal offence of Trespass & Intimidation.

3. Further you can have it removed by the competent authorities, PROVIDED you can prove that the same is dangerous for your life and property. (eg. Fire, Shock, etc....)

1. Yes, one can build a meter room in the boundary of his property. There is restrictions to build a house without the leaving the mandatory 3 feet area. But not for any other constructions.

2. So as long as this meter room does not encroach upon your area you can not do anything.

if the meter box construction encroaches on your space then you have a cause of action against the neighbour

if the meter box is constructed inside his space then you cannot complain except for the fact that constructing such a box is against the local body rules

On whose boundary wall did your neighbor construct the meter box, whether in your boundary wall or his?

Is the boundary wall belonging to him as been constructed after leaving a set back space?

If he has not left the set back space as per the rules then you may make a complaint against this with the local civic body.

On his boundary wall he can set up the meter box within his own property which should not be a disturbance to you, hence what is your problem in this?

It will be kind of you to guide me if I am correct regarding the issue. Can any one built his meter box( a permanent structure made with bricks and mortar) on boundary wall. Thanking you for your kind attention to the matter.

Until this structure is not considered as a deviation from the approved plan for construction, there may not be any legal issue in that.

Setting up his meter box in a permanent place within his boundary wall should not be a disturbance to you in any manner, hence you come out with your actual problem for which proper legal opinion can be rendered

Also, thereafter lodge a complaint with municipal bodies for illegal construction.

However, in my advise he has the right to construct a meter box inside his boundary until and unless the same is causing some hinderence to you.
