Send a Legal notice to the company for the release of the PLI and thereupon give them a specified time for doing the same.
If they do not make the payment thereafter you may lodge a case against them.

Hi, I have worked in company A for 8 years 9 months, Company A was overtaken by company B and employees were also transferred to company B with continuation of service/seniority/designation/salary structure mentioned in new Offer-Cum-Appointment letter. I had resigned from Company B in May'18 after completing 8-1/2 months; company have paid my Gratuity, Leave encasement and balance pay; however haven't paid my PLI (INR 1 Lac.) even after repeated reminders. Finally I got call from HR stating that as per Management decision, I will be paid my PLI. I had asked HR to send the same over on going mail trail, which they haven't done. Company A had formal documents/structure Appraisal process in place with defined KR's and KPI's and measuring criteria's; whereas company B didn't have any documented process in place. Please advise what are options available to recover my PLI.

Sir you can give demand notice as operational creditor as workmen asking for payment of your performance linked incentive and further since the record is.there and the amount is fixed they have to.oay same.otherwise since amount is one lakh along interest more then one.lakh a insolvency before NCLT.can be filed they will act fast.
1. The management has agreed to pay the PLI. Now wait for the PLI to be credited to your account, and if there is a shortfall in it then serve a lawyer's notice to the company B and follow it up by filing a suit for recovery of money with costs.
2. Do not initiate any legal action before the PLI is actually paid as the offended management may then put the PLI on hold.
1. The rules set in company A may not be followed anymore in company B and hence it is free to follow its own police as far as payment of PLI is concerned.
2. Now the PLI falling due while you were in company A , B can not twig it anymore but the amount falling due while in B , it can follow its own rules.
3. Now irrespective of the rules there must be some amount lying due in your name , the company is B is bound to pay once you quit this.
4. If you are not paid of the same even after several follow ups and notices you can file a case of cheating and criminal breach of trust on which basis the police can register FIR and once that is done you can expect your money flying back to your kitty.

Due you have some proof that PLI is due if so then file an application under section 33C2 of ID Act before the authority for recovery of dues.

If so on what basis, and what steps have you taken to demand the dues from them?
Have you sent any letter by registered post demanding the PLI due to you?

It is not your botheration about what the company B is having or doing on this.
You should confine to your demand alone.
If they are not paying the PLI amount then you may send a legal notice since they have already committed to settle the same.
