• Buying E khata plot in a layout outside BBMP limits

Can i buy a property which is in a layout not under bbmp limit? The plot has E khata, DC conversion and NOC from BDA. Its registered as panchayat khata.

Check whether seller has original documents of title

2) take30 years title search

3) obtain written opinion from Lawyer that title is clear and marketable then only purchase the plot

What is a khata?

A Khata is essentially a revenue document, detailing the assessment of a property, recording details about the property such as size, location, built up area and so on for the purpose of payment of property tax.

It is also a kind of identification of the person who is primarily liable for payment of property tax. It is one of the required documents in case you require a building licence, trade licence or loan from banks or any other financial institutions.

What is the difference between an A Khata and B Khata?

What any property buyer should know while buying property in Bangalore is that it should have A khata.

An A khata means you are buying a property that is legal, and it will allow you to construct on it and obtain a trade or building license. Here are some further details on the difference between A Khata and B Khata.

Then how did the term B Khata come into being?

Well in 2007 when BBMP came into being 2 things were apparent:

1) There were many properties that fell under its jurisdiction that were illegal constructions

2) There was a need for an uniform taxation policy

Regarding the former the BBMP found that these illegal constructions were enjoying civic amenities without paying taxes. While regarding the latter, there was a need to consolidate the tax collection process to make it simpler which was earlier collected by 3 different bodies.

Now, the newly formed BBMP had the power to levy taxes on the aforementioned illegal constructions. The taxes collected from these properties were recorded in a register known in common parlance as B register and the khata issued therein was known as a B khata.

Thus anyone having a B khatha essentially is a non BBMP approved construction. Hence it is not advisable to buy such properties.

However, it is only fair to mention that any B khata property can be converted into an A khata property.

Yes sir such property can be purchased, check for the conversion order to Non agriculture land as the proper fee is paid further get the title search of the property from the local advocate and see the approved plans of plot and road and boundaries

e-Khata is now given newly. Owner details can be checked online as it is electronic; your details can also be checked once you buy property and register on your name. A Khata and e-Khata are both 100% legal. B Khata can not be converted to e-Khata as B-Khata is illegal by definition. But A-Khatha can be assigned to e-Khatha. So, in future people can check whether you are the REAL owner or not by looking at your e-Khata. A Khata holders can proceed to online their details and then they get e-Khata. If you are still confusing, e-Khata is just an online version of A Khata.

E Khata refers to electronic khata that is filed online. It allows property owners to pay their property taxes online. It is panchayat khata cause situated out of BBMP jurisfiactiong. Just make sure clear title tittle of seller rest purchasable.

The panchayat khata or ekhata issued by panchayat is not valid and cannot be enforced.

DC conversion will not be sufficient if there's no layout approval.

Why and for what reason the BDA is giving NOC?

Did you refer the documents before an advocate and obtained a legal opinion?

If not do it immediately to know the genuineness of the property papers.

You can decide further course based on the legal opinion.

Yes you can buy a plot in a layout which falls outside the limits of BBMP. Such layout must be approved by the village panchayat and must have E-Katha which is issued by the Panchyath Development Officer (PDO). These plots should be duly converted from agriculture to non agricultural residential purposes (DC Converted), if this layout has obtained NOC from Bangalore Development Authority it is all the more legal and safe.

Please proceed. My suggestion to you would be, get the title documents duly verified through an advocate.
