With other share holders
have sold the land 10th oct2017.Tehsildar denied
mutation.Principals executed another poa fvg
Agent on 5th june2018 with correct plot 1127.
Kind advise how deed of

1) At time of execution of sale deed there was no POA executed for sale of plot no 1127

2) Best option is to to cancel the sale deed

3)Execute fresh sale deed on basis of correct POA

4) then apply for mutation of property in favour of purchaser

the erroneous POA will be attached to the sale deed

the sale deed and the erroneous POA would be mentioning different plot numbers

so this defect cannot be cured by granting a fresh POA with correct survey number

the sale deed will need to be rectified by executing a Deed of Rectification

nominal stamp duty will have to be paid on above deed

rectification deed must be registered

A confirmation / rectification can be executed by principle and agent that in so and so power of attorney the plot no 1127 is wrongly typed as 1167. the correct is 1127 and same should be treated in the main deed.

If there is an error in the registered sale deed or agreement of sale then a rectification deed nca be executed, whereas since the POA itself is changed now, which was unnecessary, it may serve any purpose.

You may have to get a registered rectification deed to rectify the error in the registered sale deed after which you can apply for mutation of revenue records.
