• Faulty Range Rover Engine line assembly

In April 2018 I received my new Range Rover velar and soon on delivery I noticed that there is a engine noise as we start the vehicle.The same was brought to the notice of dealer’s sales consultant.However he denied and suggested to drive the vehicle.Once again in May 2018 I took the vehicle to JLR authorised Workshop as the condition was sever.I was informed that there was a problem with balancer shaft of engine and the same has been rectified by replacement of the same part.I was assured that the same problem would not be felt in near future.
now again after 2 months the same problem has come up.When this time I sent my vehicle to authorised dealer workshop,they informed me that there is problem with engine line assembly.The entire engine shall be changed to address the issue.

As the Range Rover velar is not manufactured in India and is a CBU(completely built unit) from UK,I am not comfortable with replacement of engine as the entire assembly of vehicle in UK is done through a robotic plant.With manual intervention in assembly would not help in accurate and precise alignment I thus requested the dealership to get me the replacement of a vehicle.On this the dealership management is denying the fact for vehicle replacement.

The vehicle cost is over INR 10 millions.

Can you please suggest me the alternatives and rights I have against the dealership and JLR.

See if.the delear is getting you engine changed and further promising that there shall be no issue in future then you can go with same. The burden is on them to replace the engine manually or through machine and get you intact car.

Further if it is not possible serve the Land Rover India along dealership and service centre a notice where in claiming that it was manufacturing fact and you have to suffer losses claim.vechile.replacement and compensation .

If they do not reply notice or work accordingly file a consumer complaint in state consumer forum demanding replacement and compensation and litigation charges.

1. Based on documentary evidences & reports, you can file a Consumer Court complaint, jointly against the Dealer and the Car company, stating that vehicle is faulty and pray for replacement alongwith related damages.

2. Write to the parent Company directly about the defect and request for replacement and also follow-up on social media.

Firstly, you should serve a legal notice to the dealer asking him to either refund your entire money along with interest and compensation or give you a new car in lieu of the car having manufacturing defects.

If they fail to adhere within 15 days of the receipt of the legal notice, you can file a complaint in consumer court against them for deficiency of service and unfair trade practices adopted by the dealer as well as the company. You can also seek interest, compensation and litigation expenses along with the cost of the car in consumer court.

Hello

A complaint must be filed with the national commission for consumer complaints in delhi as the cost of your vehicle is above 1 cr.

Moreover FIR must be lodged against the owners for keeping you in the dark and for cheating criminal breach of trust and giving false information immediately with local police station.

A legal notice must be sent first detailing their acts and omissions and demanding instant relief.

1. This is a deficiency in the product, hence actionable before the consumer forum under Section 12 of Consumer Protection Act through a complaint case. Serve a lawyer's notice to the company and dealer seeking replacement of the vehicle and damages for mental agony along with cost of legal notice.

2. If your demand is not met then a complaint case can be filed before the Consumer Forum to seek refund of the amount of vehicle along with compensation and litigation cost.

The Consumer guarantee Act CGA guarantees mean the vehicle should be

of acceptable quality – reasonable in look and finish, durable and safe

fit for purpose – either generally or to meet a specific purpose you told the dealer before you bought the vehicle

as described – match the description in advertising or anything the dealer said at the time.

If one of your guarantees hasn’t been met, you have a right to go back to the dealer for a repair, replacement or refund.

Looks like the car was defective right from the minute it was rolled out from the plant.

You are rightly insisting for replacemnet of the car itself,

Send these people, the dealer and range rover India a legal notce and escalate your grievnces by means of this legal notice. Seek replacement of the complete car through this notice.

In case they fail to comply with the legal notice, approach the NCDRC and file a case.

Hire a local advocate and send a legal notice to the dealer as well as the manufacturer. U will get positive response. In case you don't receive any response, file a consumer complaint. Hire a competitive advocate.

The dealer is not an authority to deny this especially during the warranty period.

You can escalate the matter to the company itself directly and report the communication sent by the dealer in this regard.

You can express your dissatisfaction on this and can seek their intervention to instruct the dealer to replace the vehicle as proposed by if what you say is found to be correct.

However you have to go through the terms of warranty in this regard for initiating any legal action on it under the given situation.

If you find any violation or breach of any conditions of warranty by the dealer, you can issue a legal notice to him demanding your requirement of replacing the entire unit /car as per the terms or else to drag them to consumer forum and may implead the being the car company also as necessary party to the consumer case to put pressure on them.

The company will take it as prestige issue and may offer replacement to avoid spoiling of the reputation in the market.

Secondly, you should file a National consumer forum as the price of the car is above 1 Crore.

Thirdly, give the same plea to change the vehicle or get the same be assembled from their only.

Hi,

In normal case the repair solves the purpose, but if you are not satisfied with service; send them a legal notice for re-assembly by robotic plant/replacement of engine. If not done by them, file a case under consumer laws and ask for compensation.
