• How to change date of birth in passport

My daughters dob is [deleted] in muncipal date of birth certificate. The actual dob is i day less i.e. [deleted]. and the hospital record is [deleted]. and its a mistake of muncipal clerck. i have taken passport using muncipal certificate. but in all other educational certificates it is correct dob only ([deleted]) Muncipality is not accepting my request to issue new dob certificate. passport officials asked me to bring corrected dob from muncipality. kindly suggest a solution to my problem

Sir file before the magistrate court for declaration and amendment of birth certificate since the hospital records are evidence and it was mentioned by mistake in birth certificate the court shall pass an order directing municipal authority to change the DOB in the certificate.

Based on the certificate of DOB the passport authority shall amend the DOB in the passport.

sorry your question is incomplete..

if you have hospital record then you can apply at muncipal office for new birth certificate.

if hospital date of birth record is also incorrect then you can apply through affidavit.

else contact any broker definitely he will solve your problem.

Hi

1) When date of birth is conflicting between municipal records and hospital records, the municipality is duty bound to change.

2) For change in date of birth certificate, you have to approach the local civil court and file a petition for change of date.

3) The court will call for birth records of hospital and also the municipality and issue a decree based on hospital birth records.

4) It will take about 4 months for change of date of birth in municipal records through court.

Municipality will not issue a birth certificate with a different dob unless you bring a court order. You can file a writ petition to direct the municipality to issue a fresh birth certificate with the correct dob on the basis of hospital record. What goes in your favour is that the dob is uniform in the hospital records and other documents.

1. Your daughter should execute an affidavit before the local 1st Class Judicial Magistrate affirming that her correct DOB is such and such which has been recorded in her certificate issued by the Corporation as such and such due to human error which is required to be corrected now by the Corporation.

2. After you receive he affidavit signed and stamped by the said Judicial Magistrate, you can file an application before the Corporation annexing the copy of the said affidavit seeking issuance of her birth certificate with correct DOB as mentioned in the affidavit. Fresh birth certificate will then be issued by the Corporation for your daughter.

If the municipality is giving a reply refusing to rectify the mistake on their part then you may approach court of law for remedy.

You can file a suit for directing the municipality authorities to rectify the error committed by them in this regard by filing a mandatory injunction suit against them.
