• Writ petition in HC Mumbai

Thanks to all advocates who replied to my post undee section 151 cpc to recall the order of lok adalat. i understood that there is no option other than to file writ petition under article 226/227. However in this regards, please reply on below.

1. The fees of Adv in HC mumbai is much more higher, beyond the capacity therefore whether my close relative who practice in district court being his marathi language . he wont take fees but he may not present and argue in english. therefore if i or he apply to HC mumbai to allow them to argue the matter in marathi. whether it will be allowed? (i have already asked to my relative but he said if it would be in marathi, he can but whether such application is allowed or not, he has no idea, hence this question)

2. if the same is not allowed can any body suggest advocate's name and contact who can conduct this case on the basis of part payment. 

3. what is time limit to file a writ petition and from which date it is calculated.

Your lawyer can argue case in Marathi if he is not conversant with English language and judge permit s him to argue casein Marathi

1)Indian Languages in particular local languages

of a state are not allowed in High Courts and

Supreme Court.

3) The normal time limit for most types of cases is generally 3 months or 90 days. However, while there is no specific limitation period for filing a writ petition in high court, it is expected that it would be filed without any unnecessary delay. In any case, the delay should be explained by citing justifiable reasons.

Firslty, Sir, though the language of the High courts is only English, but yet there are advocates who argues in English inclusion of some Hindi words in it (not totally in Hindi or any other Regional language).

Secondly, first of all sir, you may be able to find some good advocates who would charge you less also through our forum.

Thirdly, as I always practice in Writ matters in Delhi High Court, but would cost you almost 15K for each hearing including flight fares.

1. Sir this is rarely done as far as in my knowledge only four high court so far has allowed to argue and present in Hindi. So better engage advocate ( advocate who recently started practice) or take help from the high court legal aid authority to present the case.

Your query is not only ridiculous but also shows that how much faith you have in Advocates and judiciary, I suggest please don't ask anyone and straight away go to High Court inquire there and go ahead. Best of luck.

He is enrolled advocate, with the persimmon of court, he or you can delivered argument in Marathi but petition will be file in English only.

1. If he is a practicing advocate in the district courts in Mumbai, there is nothing wrong in he presenting his arguments in high court with the support of any junior practicing in high court.

This is a local issue and not involving any legal issue hence you have proceed accordingly.

3. There is no time limit for filing writ petition but it should not be delayed inordinately without any sufficient cause for approaching court at a belated stage.

The official language of the High Court and Supreme Court is English and very few high courts have allowed the local language to be used as judges of high courts are from all parts of India in many can only understand English and their local language.

So, it's unlikely that your application to argue your case in Marathi would be allowed. Pleadings are also to be filed in English.

There is no specified period of limitation for filing writ petition in High Court or Supreme Court.
