• Regarding registration of HUDA plot in Gurgaon

A plot has been purchased in gurgaon jointly by 3 ladies. In the registry signature of buyer is mandatory ? If yes, do all the three ladies need to be there for the registry? If only one or two ladies are signing as buyers on the registry then while selling that property in future the sale deed will need signature of only the ladies which will sign on the registry or signature of all three owners will be required at that time?

1. In the sale deed the signature of both the seller and the buyer is mandatory as without either of them sale is not complete.

2. If any of the parties is not in a position to attend in person any sign physically then she can give a registered POA in favour of any of their near relative.

3. So the registered POA is enough to dispense with the personal attendance of the parties.

Any lady can execute POA in one lady, than other 2 ladies presence will not required for registration of sale deed.

Yes, all three need to sign as buyer.

One can sign on behalf of all, only when the other two ladies give a POA(power of attorney) to the one who signs.

Signature of all three will be required even at the time of sale, unless the POA route is followed.

Ans: Yes.

Ans: Yes. However, the lady present at the time of registry can sign for self and on behalf of the lady/ies who is absent provided she has given the POA to the lady present at the time of registry.

Ans: Signature of all the ladies are required. Or, the lady selling on behalf of the other ladies can get the POA from other ladies in her favour at the time of sale also.

Yes POA can be given for both the purpose of sale and purchase.

There can be single POA now only.or there can be subsequent when you intend to sell.

Please, do not go by POA of GPA as it is now very well settled by the latest jugdements of the Supreme Court that the seller buyer both should be present.

Though certain expeceptions are there, but that would not fit in your case.

The seller and the buyers have to sign on all the papers of the registered sale deed document or else it will not be a valid and the sub-registrar may not register the document.

When the sale deed cannot be registered then where is the question of buying it or selling it after that.
