• Correction in my name and mother's name in my birth certificate

Dear Sir.

My name in my birth certificate needs to be corrected from Shelton Domnic Coutinho to Shelton DomInic Paixao Coutinho. Here I need to add an "I" in my middle name and I also need to add my third name as mentioned in all my documents (passport, Aadhar etc) Paixao is my third name mentioned on all my documents (Baptism, Passport, School leaving, graduation etc etc). Can this be done?

Secondly, my mother's name also needs to be corrected from just Felcy which is mentioned on the Birth certificate to Felicia Carmelina Coutinho which is actually her full name on all her documents (Aadhar, pan, bank, passport etc) Can I make these changes on my Birth certificate? If yes, what is the process to get this done. I really need desperate help on this.

Everything You Need To Prepare A Name Change Affidavit

An Affidavit is a “statement in writing purporting to be a statement of facts, signed by the person making it and confirmed by him/her on oath, before a person with authority to administer oath such as an Advocate S.E.M., Executive and Judicial Magistrate, Oaths Commissioner or Notary Public”. The affidavit for change of name is therefore a document of swearing or affirmation, which confirms your identity, both former and the one that you wish to make a transition to.

The Affidavit can be attested by an Advocate S.E.M., an Executive and Judicial Magistrate, Oaths Commissioner or a Notary Public. 1) apply to registrar of birth to rectify your birth certificate

2)if your application is rejected you would need court orders to direct registrar to correct your birth certificate

3)similarly to correct your mother name you would need court orders as registrar would refuse to do it after so many years

With requisite id proof visit the municipal office and request a name correction in your birth certificate .Also you will require affidavit to this effect of name correction .

If the municipal authority accept you request than they will give you correct Birth certificate in case of refusal you need a order from Court directing municipal authority to change the name of your and mother in birth certificate.

Though name change in birth certificate is not permissible the name cannot be struck off you strictly need order from the court though there are notification allowing one time amendment.

So it's better to request and on denial approach the court to direct the municipal authorities to change the name.in the birth certificate.

1. The change of name is the Birth certificate is not permissible unless it is done almost immediately.

2. however one can change the name anyway later on by making an affidavit before the first class Magistrate and then making a newspaper publication or gazette notification.

3. however the name appearing in the birth certificate will remain unchanged.

Please contact the registrar of birth to get the name changed on your birth certificate.

Though changing the same in educational certificates will be a difficult task but the same can also be done.

Initially, move an application with the concerned Authority(Registrar, Births AND Deaths) requesting him to make the requisite changes.

In no action is taken pursuant to your application, file a writ of mandamus and seek direction from the High Court in the present matter.

The next step is to publish an advertisement in two newspapers- one in the official vernacular language and the other in English.

Yes, it can be done just putting a little efforts.

Make an affidavit disclosing the reason doing the same, any reason, need not be very justified.

Then Gazette notification on any local newspaper, would be good if two three different newspaper be used for the same.

You have to adopt the procedure meant for change of name, by first executing a notarised affidavit, get a public notice published in a leading local newspaper and if need be to get the cahnge of name published in the government gazette publication.
