Hello there,i am really confused about whether i fall under obc non creamy layer category or not.been trying to wrap my head around various criteria looking for them on the net but honestly clarity still eludes me.so would like your help in this matter so as to appropriately fill the relevant information while seeking jobs..i am providing you with relevant info to deduce my status.thanks in advance..eagerly waiting for your response

i am a student preparing for civil services exam,my mother is a housewife.my father was directly recruited to group B gazetted post in drdo,min of defence as stores officer in 2004.he got promoted to group A when he was 48.his current salary per month is 80K excluding HRA ..

Hi, if the annual income of the family exceeds 6 lakhs per Annum then you are considered to be in a creamy layer

If only your father would have got promoted into group A(from group b) before age of 40, then you would have fallen in the creamy layer.

But please note only if your father was promoted to grade a post before age of 40 you will fall under creamy layer. If not you can claim OBC status. You cannot make changes after submission of CSE form.

as per the Central creamy layer criterion II & III dated 08.09.1993 only the sons and daughter of following “government servants” will be treated as creamy-layer.

(i) Parents, either of whom is a Group-A officer. (Direct Recruitment)

(ii) Parents, both of whom are Group-B officers. (Direct Recruitment)

(iii) Parents of whom only the father is a Group-B officer and he gets into Group-A at the age of 40 or earlier.

So yes you will get obc NCl status.

Get NCl certificate and apply for changes in form it shall be entertained according to guidelines of exam so that need to be perused. Kindly send the notification of exam that need to be referred by way of communication contact exam Conducting authority and have a word with them regarding change. In salaried employees only post is seen not salary

If father was recruited direct to class 2 position and than promted to class 1 before age of 40 than it would be no longer NCL.

Therefore in your case you will be considered as NCL and will get the benefit of reservation.

Your father was recruited as Gp-B officer only.

He was promoted to Group A post after 40 years of age i.e., at his 48th year of age.

The rule in this regard says that if father was recruited direct to class 2 position and than promoted to class 1 before age of 40 than it would be no longer NCL. However this scenario applies only if the father has been promoted to Gp "A" post before attaining 40 years of age, if he had been promoted after 40 years of age, then he comes under NCL-OBC category and his wards are eligible for the concessions under OBC NCL category.

Therefore you are eligible for the concessions meant for NCL category.

i am unemployed .i have filled up my category as obc creamy layer in cse (civil services exam)2018 application for though i have a sneaky suspicion that i am eligible for reservation.your help will allow me to make the necesarry changes..am i allowed to makes changes after submitting the cse form?

You have done a mistake by filling up the details that you belong to OBC creamy layer,whereas you are eligible for NCL concessions. If the rules permits you may try to change the category from creamy layer to NCL at a later stage when you are selected for interview.
