Hello,

Fauzdari ke madhyam se aap kabza nahi le sakte hain. Ye mukadma fauzdari me nahi chal payega, isko aap diwani me daliye aur wahan se aage ke construction pe stay order lijiye aur court se dharkhwast kijiye ki use aur aage koi construction nahi karne diya jaaye.

1. In these circumstances you may file a suit for partition to divide the property through metes and bounds whereupon the court will order the division of property.

2. Also seek temporary injunction to restrain your uncles from making further construction on the property.

Hi, since the partition suit is under consideration with the tehsildar, any construction by him will not be valid. You are suggested to file appropriate application with the SDM/DM of you area and obtain a stay order on his activities.

You can file a partition suit seeking your legitimate share in the property and separate possession.

In that you can file an application seeking injunction restraining the defendants from disturbing your possession and also to not to alienate or encumber the property in any manner.
