I have filed cheques bounce case for my payment due since last financial year. Mine is a sole proprietorship firm and has not traded in this financial year. I want to close that firm but I am concerned will it impact the case. Bill was raised in last financial year and cheque bounce case is going on. Kindly advise if I can close the firm?

Hi, the previous transactions are sufficient to prove the liability of accused .. Closing of from will not have any impact upon your case
This will not affect your case and you may get the amount as awarded by the court in your name as the firm is closed.
1. Closing of your business does not in anyway effect the outcome of cheque bounce case.
2. Cheque bounce case was filed as accused failed to discharge his dues which he was liable to pay legally.
3. You may very well proceed with cheque bounce case and recover the cheque amount with interest (Fine).
The pending case will not be effected.
You will be able to pursue this case, even after winding up your firm.

Closing the firm at a later stage will not effect your cheque bouncing case, you are at liberty to close the firm and continue with the pending case.

No- It will not impact your cheque bounce case under section 138 n.i.act , as you have already raised the amount in the cheque as per your last transaction bills with the said accused person. Even if you are going to close that firm it will not create problem in the proceeding of that case, because due to the said loss by the customer you wanted to do so.
The closure of the firm will have no impact on the pending cases as the cause of action in respect of the pending cases does not lapse with the closure of the firm.
Closing of the firm has nothing to do with the pending cheque bounce case.
You can very well close the firm which is purely your own decision and not concerned with the cheque bounce case which is already going on in the trial court.
