Hi Mera Name Mahender Gaur Hai or mail Delhi ka rehne wala hu.

Mere bête ki shadi 2 Nov 2009 koi hui, meri bahu ne meri family pe domestic vioilence ka case dala hai on 15 August 2014 me.
1. 15 August 2014 me us ne mere bête to tihar jail karwa di
2. Mere bête ki bail 18 August 2014 ko ho gai or fir wo mujhe of mere parivar ko safe karne ke liye 19 August 2014 ko hame chhod kar rent pe rehne laga.
3. 26 August 2014 ko main apne bête ko bahu ko apni property se bedakhal kar diya
4. 29 August 2014 me meri bahu ne case dal kar 30 hazari court me case dal kar ki ham use marte hia pitate hai jo us se ban paya wo likh kar ghar me rehne ka order hasil kar liya.
5. 1 September 2014 ko usne apne parivar valo ke sath mil kar rat 2 se 3 baje ghar ke samne sidhi laga kar ghar ki chhat pe chhad gai or khud ko marne lagi or police call karke police ko ye batane lagi hamne use mara hai. Fir in sab ki kuch tasvire CCTV me ai bhi but us din usne hame ye bataya ki uske pass order hai jisme ye likhe hai ham me se koi ghar wala use bahar nahi nikal sakta.
6. Uske bad ham ghar chhod ke apna khud ka rent pe rehne lage. Or hamne wo order pe ghar vacate karane ke liye case bhi lada.
7. April 2016 me jab ghar vacate ka order hona tha to meri bahu ne apna kiya hua case court se withdraw kar diya.
8. Ab main is chij ko leke jawab chahta hu, ki jab usne apna case wapis le liya hai to kya use pas jo ghar me rehne ka order hai kya wo abhi bhi lagu hota hai ya nahi. Because wo mere ghar me abhi bhi kabja karke baith hai or mujhe or mere parivar ko ghar me rehne nahi deti or jhagda karti hai.
9. Because main 76 year ka senior citizen hu jise heart problem bhi hai.
10. Meri wifi 58 year old hai jise low blood iron ki problem hai.
11. Main pension pe ji raha hu or rent afford nahi kar sakta or mere ghar me mujhe meri bahu rehne nahi deti.

Agar ghar me rehne ka jo order tha wo antrim aadesh tha to wo valid nahi rahega agar usne case wapis le liye hai, par agar wo final order that to wo valid rahega. Mere khyal se wo aadesh antrim aadesh hi hoga, aur ab wo valid nahi hoga.

To agar usne wo case wapis le liye hai to aap usko ghar se nikal sakte hain. Aur apne case me vacate ka order karwa lijiye

You hav e to file case against your daughter in law seeking court orders to direct her to vacate your house

2) seek permanent injunction restraining her from disturbing your possession of the house

3) seek expedited hearing as you are senior citizen

4) interim order passed in favour of daughter in law stands vacated on withdrawal of the case

Yeh Makan Domestic Violence Act ki dhara 3 ke tehat shared household ki paribhasha Ke antrgat Nahi Aata Hai. Isliye aap ki Bahu ko is Makaan Mein Rahane ka koi Adhikar nahi hai. Yeah sabit hai ki aap ka beta Kiraye ke Makan mein rehta hai isliye Domestic Violence Act ki dhara 19 mein aap ki Bahu ko Kewal Kiraye ke Makan mein residence order Lene Ka Adhikar Hai. Yadi magistrate mein aap ke Makan ke sambandh mein residence order pass kiya hai to aap ek revision file kar Usko challenge kar sakte hain.

1. Wife has no right of forceful entry or residence into a house unless a competent court of law passes necessary order.

2. If there is such order indeed then he can preferrl an appeal or seek modification of order.

3. If the house forcefully occupied by wife doesn't belong to her husband then court can not pass such order.

Aap jaiye Appeal file kariye us order ke khilaf jisme bahu ko rehne ka right mila hai.

Agar bahu ne mukadma wapis le liya hai to court me vakeel ke thru questionaaire daalke ye cheez pata karein aur police ko itla karein.

Yadi bahu ko ghar me rehne ka aadesh hua hai to iska ye matlab nahi hai ki aap ghar se nikal jayenge, jaiye aap apne ghar me rahiye. Aapko koi nahi rok sakta apne ghar me rehne se

Jab apki bahu ne apna case wapas le liya hai hai, to usi ke sath jo residence order apki bahu ne apke khilaaf liya tha, wo bhi vacate ho gaya hai.

Ajki tarikh mein, aapki bahu ka apke ghar pe kabja illegal hai.

Court mein eviction ke liye proceedings initiate kijiye aur kabja hasil kariye, apni prperty par.

Police ko samjhaiyye ki wo residence order valid nahi hai, kyunki jis case mein wo order paarit hua tha usko withdraw kar liya gaya hai. Jis order se ye case withdraw kiya gaya hai wo bhi Police ko dikhaye.

Agar uske baad bhi Police apke case mein koi mukadma darj nahi karti, to High Court mein case kariye.

Ghar to aap hi k naam hai toh aap jaa k bilkul usme reh skte hai. Agar police aati hai toh kahiye k hum isko nikal nahi rahe hai yaha rehna chahte hai iske alawa hmare pas aur koi ghar nahi hai. Aur chahe toh bahu k khilaf case daal skte isi bare me jise suit for possession kehte hai.

Ab main is chij ko leke jawab chahta hu, ki jab usne apna case wapis le liya hai to kya use pas jo ghar me rehne ka order hai kya wo abhi bhi lagu hota hai ya nahi. Because wo mere ghar me abhi bhi kabja karke baith hai or mujhe or mere parivar ko ghar me rehne nahi deti or jhagda karti hai.

If she has withdrawn her case for residence then you can make her vacate the house by a court order. What about your eviction petition, did it go through and you got an order in your favor?

But local police "Uttam Nagar Thana" saying uske pass ye order hai but tum logo ke pass koi order nahi hai jisme likhe ho ke bahu ko ghar nikalna chaiye, Police saying ham kuch nahi kar sakte, meri bahu mujhe mere ghar me ghusne nahi de rahi... from last 3 yeard jisme uske ghar wale bhi uske sath ham or ham dono senior citizen hai kuch kar bhi nahi pa rahe who will help us...

court me DV ACT me wife ki taraf se file kar diya ki mera ghar khali karwaya jaye but wo bhi sirf 1.5 saal se 1 date lagi hai kuki har bar judge chutti pe hoti hai .....

But you have mentioned in your previous post that you have filed an eviction suit which has come in your favor hence she withdrew her case.

What is your statement, why do you contradict your own statements in a post after post?

You may not get proper opinion if you furnish contradicting information while seeking advise or opinion to your problems.

Since the cases are pending before court, you have to follow it up properly instead of taking any short cut decisions which may actually hamper your process.
