Hi , we have to file a civil suit for eviction in court .. They cannot be termed as tenants as they are not Paying any rent and are illegaly occupying the premises .. It is basically a illegal encroachment .. It is also advisable that a Criminal complaint is filed against them by your mother with the police that after the demise of her husband they are illegaly trying to take posession over the property ..
The civil suit may take 12-18 months, but try and lodge a FIR against them , as it will create more pressure upon them to vacate the premises
Issue then legal notice to vacate the property
2) if they refuse file suit for eviction of trespasser
3) it would take 10 years for suit to be disposed of
If any permissive occupier is not letting the proeprty vacant then only way to to get it vaced is to file a suit for eviction of a licensee.
So you will have to file such suit asap for which get in touch with an advocate,

If they are neither tenants nor the title holders, at best, they are illegal occupants.

Dear Client,
ur case is not complicated, approach court will get definite relief, Court will provide u immediate relief, if bring fact to court, that they own residential property and trying to encroach on ur property, and demanding money to vacate. even ur mother can file FIR against them for trespass and living illegally without her permission.
You have to first issue a notice asking them to vacate the house which was let out to them temporarily on the basis of love and affection owing to their immediate residential requirements.
Failing to comply with the demand made, you may file an ejectment suit to eject them from the property along with damages.
The time taken for disposal cannot be predicted owing to various factors involved in the conduct of the case.

Since they are not tenants, they cannot claim tenancy rights in any manner hence you can proceed with the sale of the property if there is a buyer to buy the property on the basis of as is where is.
