• Name on Agreement and Share certificate

I purchased a flat in 1991 in Mumbai. My name on the agreement is ABC as I was married that time, which is duly registered. Society got registered in 2003 by that time I got divorced, so I applied to society to change my name as XYZ. Society admitted as XYZ and later issued share certificate in the name of XYZ.

I have got my name change in The Gazette from ABC to XYZ.

Now, I intend to sell the flat. Will there be any difficulty? As agreement shows as ABC whereas Share certificate is in the name of XYZ.

No, this discrepancy in name will not be a problem.

At any time there is a problem, furnish an affidavit stating that you underwent a name change.

There will not be any difficulty.

Keep handy the newspaper publication wherein you have changed the name and get an affidavit to the extent which says that ABC and XYZ are same person.

No, it shall not be a problem since you have changed your name legally. But if any problem is created during the time of selling the property, you can always make an affidavit stating that ABC and XYZ are the same person and also state that you have changed your name from ABC to XYZ.

1)there would be no diffculty in selling flat as your name has changed to xyz and change of name is reflected in share certificate

2) i presume there is gazette notification of change of name and it is published in 2 local newspapers

There will be no difficulty since you have changed your name in Gazette just add the certified copy of Gazette along with the sale deed to the person who will buy your property....

Mo there will be no problem in selling the flat as you have legally changed your name. The certificate of the society and name change will be the part of the documents along with your PANand Adhaar card to complete the sale.

The name in the registered sale deed cannot be changed.

However since you have proof to prove that you have changed your name after purchase of this property, you can attach the copy of the proof along wtith the fresh execution of sale deed in favor of the new purchaser and trhe recitals made accordingly in the proposed sale deed.
