  • Extend stay in house for short duration

- I am staying in a rented flat with a 2 years registered rent agreement ( Delhi). 
- Paid Rs 36,000 rent per month the first year and increased to Rs 38,000 the next year ( as per agreement)
- However I seek to extend by 6 months ( may vacate earlier too) and willing to share cost of new registration for 11 months. But the landlord is seeking much higher increase in rent then what i am prepared to pay and if not is seeking my vacation of house by due date ( for which he would be sending me notice).
I wish to avoid unplesantness and at the same time not incur unnecessary expenditure as also discomfort of shifting to another flat for a few months. What options do I have. I have asked the landlord to be reasonable

1) ask landlord to enter into leave and licence agreement for period of 6 months

2) agree for nominal increase in rent

Legally speaking, You have no option but to vacate the house after the elapse of two years of agreement. You paid the rent of Rs.36000/- for first year and Rs.38000/- for the second year. Now, you want to seek extension of 4 to 6 months with increase of rent but he is not ready and seeking much higher increase. The option available with the landlord is to send you notice after elapse of 2 years. Let him send the notice and ask him that I am looking for the new accommodation and will vacate immediately on receipt of new accommodation. Reply to his notice accordingly and let him go to the court. Taking legal recourse, you will get four to six months time and then vacate the premises. Once, you took this stand, the landlord will come to amicable terms. He is applying the tricks to get the rent increased, that' all.

Hi, it is best advised to settle the matter amicably as any legal process will involve additional expenditure.. If no settlement is made then let him file a eviction suit , you can make a plea before court to give you a resonanble time to vacate the house

If you have plan of staying only for few months then you can refuse to adhere to unreasonable demands of your landlord.

Continue to make payment of rent in the present rate and then leave once yout time comes.

No landlord can increase at such a pace with upswing trend.

Dear Client,

Extension may be possible with mutual consent or according to terms of agreement. IF u want to continue more months than keep paying him rent and don`t vacate the premises. Landlord cant evict u forcefully/without following due course of law.

Avoid his legal notice , than he will need to file eviction suit,and till the notice will issue and suit will proceed ,u will get enough time 6 months for easy.

Than vacate the house, cause of action will not left, suit will dismissed for want of cause of action.

As such you do not have any option.

Either be reluctant do not leave and keep on giving him the rent

Till the time he will file the eviction suit, appear before the court and say that you have paid the rent and now you are leaving also.

You may talk to him calmly for the extension.

See you need to just pay a rent continuosly, and if he send you a notice then send him a reply to the notice about your requirement. And do not forget to pay the rent alongwith the penalty or something. It will solve your purpose surely.

You could send a legal notice to your landlord, asking him to seek your eviction only in accordance with law.

He cannot be unreasonable and act dehors the rent control laws.

If you are not able to bear the additional expenses in the name of hike in rental amount, you remain silent without taking any action on the basis of your earlier request to extend the tenancy.

Let the landlord send a notice, you give a reply notice and file a caveat petition before the jurisdictional court which is valid for three months, hence the landlord cannot get an exparte injunction agaisnt you nor he can be able to vacate you immediately.

If the landlord refuses to accept the monthly rent, you may send it by money order to his address. Let him return the money order with reason refusing to accept the same, you can issue a legal notice to him asking him to furnish his bank account details to which you can directly transfer the rental amount.

If he is not furnishing or refusing to this option also, then you may file a petition before the rent control court seeking its permission to deposit the rental amount with the court.

All these legal processes will involve more than 6 months time, by which you can comfortably shift to any other place of your choice with no much expense.

Once you have shifted to some other place then the landlord will run behind you to collect the arrears of rent through court or in person.
