I was caught at a road block for drunken driving. They checked my breath which showed positive, and they even made a receipt with my alcohol level. The police allowed me to go home after some time at the police station where they took a few signatures and asked me to go back there the next day and to pay RS. 2,000 for DUI and 1,000 because I did not have my license. Is there a way I can hire a lawyer to go on my behalf to the court and pay off the fines or do I need to be present? Also, what penalties am I looking at?

you have to be personally present in court on the next date

2)your advocate presence would not suffice

3)The amount of fine you pay is directly proportional to the level of alcohol running into your blood.

4) if it was 30 to 60 mg alcohol then fine would be Rs 2000

5) if it was 60 mg to 150 mg then fine would be Rs 4000

To make such payment you do not need an avocate.

However if you do not wish to attend in person to make such payment then you can engage one.

In most cases it is done by touts who roam around such area and do the needful for a fee.

Section 3 in The Motor Vehicles Act, 1988 says No person shall drive a motor vehicle in any public place unless he holds an effective driving licence issued to him authorising him to drive the vehicle.

You can contest the case. You will appear the court at the time of getting summons from the court and take bail and contest the case. Breath Alcohol Analysis Test is admissible piece of evidence under section 203 M. V. Act.

You should also carry all the requisite documents with you while driving. These are:

1. Driving License - Original

2. RC - Attested Photocopy or Original.

3. Insurance - - Attested Photocopy or Original.

4. PUC - Pollution Under Control Certificate - Original.

Hi

You can hire a lawyer to pay the penalties. But the penalized amount is 3000/- and a lawyer would also charge some amount , why to increase that.

It would take hardly 30mins to pay the penalties in court.

Go there and pay yourself.

Sir, it is just a simple fine and don't need to hire a lawyer for that. Simply go the court when you get the summon and pay the fine.

This is petty case, hence you may approach the court police and express your decision to admit to the offences as charged, he will prepare an admission petition after which the court will impose penalty which you can settle it by paying the fine amount and obtain a receipt for this.
