• Criminal Cases against Forgery of Govt. Record (Agriculture Land)

In the state of Telangana, A Pattadhar pass book (Govt. record of Agricultural Land holding given to an individual by the MRO and RDO offices) has been declared as a fake by the regional RDO court recently.

Please let me know what all criminal cases can we lodge against this fraudster?

How effectively can we implement section 463 to 476 (chapter xviii : of offences relating to documents) against the same fraudster?

Moreover, this fraudster is a Govt. Nurse in the mandal health care office.

Hello,

it is not upon you to invoke sections, you give a written complaint to the police station with regards to the Fraud and the police ill lodge an FIR under the relevant sections.

However, for the facts as provided by you police in all probabilities will invoke relevant section under chapter XVII of the IPC. Additionally the police may invoke other sections also depending upon the content of the FIR.

Lodge a complaint under those section s witht he local police.

If police does not register FIR then file case with the Magistrate u/s 156(3) crpc.

If the police does not make proper investigation file writ petition agaisnt police inaction.

Inform the Medical hospital about the involvement of the Nurse so the authority may start departmental proceeding agaisnt her.

IPC 465,467,468 420 are very well attracted.

Go ahead and file a criminal complaint.

Accused can be prosecuted for a term of 10 years.

Lodge a FIR against this fraudster under sections 468, 470 and 471.

Besides the above, include other relevant offences, which this fellow is guilty of committing like 420 etc.

You may file a criminal case against her before the police or court, the police is duty bound to registered a case against her because there is an cognizable offence committed by her.

If the police is not ready to take action against the accused then you may approach to court and file an application U/s 156(3) of Cr.P.C. and file a Supreme Court Judgment "Lalitha Kumari Vs State of U.P."

Such cases of playing fraud in respect of Govt., Agriculture Land allotting an individual by way of Pattadar Pass Book and Title Deed etc., will be treated seriously. You can implement all the attractive sections including forgery, fabricating false documents, fraud, dishonest intention, criminal conspiracy, misappropriation of position as a government official etc., by lodging a written complaint before concerned police, revenue higher authorities viz., Chief Secretary, Revenue Spl., Sectary and District Collector etc., You can also lodge a complaint before concerned local police. If police not initiate any action than, a private compliant can be filed before concerned Magistrate Court seeking refer the matter to police for inquiry and report under Section 156(3), 190 and 200 Cr.P.C. Severe action will be initiated since fraudster is a Govt Nurse. An inquiry will be ordered and may be suspend her from her services.

you have a number option left as it was declare fake by the RDO court firstly take a copy of order from the said court and go streight away to police station and lodge an FIR aginst them under ...

1 - 465 - forgery -making of false document with intent to damage ..

2 - 467 - forgery of valuable security..

3 - 471 - use of a forged document ..

these are the option we have left in these section of IPC we can file or lodge an FIR against all the said accused ..

If the pattadhar passbook had been found to be fake then the RDO itself will order for an inquiry or lodge a complaint on the basis of your request to the concerned police about this forged document.

You may make a representation before the authority or lodge a complaint to the police if you are directly affected by this act of the accused.
