• Dividing land when we have 3 owners name

Hi,
This is chandrashekar and living in Bangalore, i have a Family Property in Davangere Dist.
It is Farming Land of 6;35 Acr and in RTC 3 Owner name is mentioned 
1. My Father actually we should get 3:50 Acr
2. Other Owner their share is rest of the property (but we not have any registered nor document for sharing thing/ actual Property size)
3. Added from 1951 RTC accidentally but not have any rights on the land

Now Land is in our hand and we only taken care of everything but now we planned to divide in RTC.

Please help me out how can i take further steps on this

1) deed of partition or family settlement can be executed for division of land by metes and bounds

2) deed should be duly stamped and registered

Pleas approach the jurisdictional taluk survey authority and get the property surveyed and for Durasthi wherein the surveyor measure the land in presence of the neighbour land owner by giving notice to them, once the boundary is fixed based on the survey records and in the presence of the neighbour land owners it will again go through process under the Karnataka Land Reforms Act and The Assistant Commissioner of that area fix the land assessment, and with the approval from the revenue authority new Sy No. will be assigned for the land extent you are eligible for.

And then after that eventually deed of partition can be entered upon between A and B.

Deed must be duly stamped and registered in order to avoid an legal hurdle in future.

The RTC is not a title document.

A registered document only shall show the owners of the property

You say that there is 6.5 acre and 3 owners name are mentioned in the RTC, then what is the reason that your father getting 3.5 care?

Have you made an enquiry in this regard with the village revenue officer or the taluk revenue officer or Tahsildar?

You say that the land is in your possession and enjoyment whereas there is no mention in the RTC about this, then how do you claim the ownership and on what basis?

Since you are not able to explain properly about the issue, it would be better that you consult a local advocate and get all the things clarified in person or revert with proper details to get a proper opinion.

we have A, B and C 3 people in RTC but actual owner is only A&B, C is added in 1951 RTC unknowingly so now we can make a Deed with A&B saying we are actual owner and we are responsible for all future disputes like that right and we can take out C name in RTC, if it is like this can you please provide the process to follow ...?

The name of C was included in the year 1951 and it is more than 65 years that the name of C is present in the RTC, how do you say that his name has been included unknowingly?

What is the title document say about this?

The RTC no doubt is not a title document, the ownership of the property will be decided on the basis of the property registered documents only.

You ascertain all the facts and consult a local advocate on this.
