• E Khata for DC converted industrial land

Hello Sir,

I have an option to buy 5 acers DC converted Industrial land in Tumkur, Karnataka. The E Khata if for the land usage area only, which is in Sq mt that roughly translates to 3 acers 19 gunts. balance is earmarked for Park area and Parking. The seller of the land is demanding money for the entire 5 acers and not 3 acers 19 guntas. My question is does the place earmarked for the Park becomes the property of Govt? If so why should I pay for the park area as well. What is the general thumb rules followed in such deals. The present owner of the land has not executed any relinquishment deed to the Govt. If I buy the land should I execute a an relinquishment deed going forward? If i were to compare the same with KIDBA alloted land of 5 acers, will the Ekhata after the the initial lease period reflect the entire 5 acers of the land usage area of 55% to 60% only?

Area reserved for Park becomes the property of land nad yes in my advise you msut execute a relinquishment deed.

1)dont purchase the land

2) you would be getting only 3 acres 9 ghuntas but have to pay for 5 acres

3) there is reservation on the plot for parking purposes

4) you should not pay for the parking area

Hi, when the land is reserved for civic amenities then the seller has no authority to sold the property and vica versa.

Extract of 'E' khata of the property that you buy would cover only 3 acers 19 guntas. So, you don't have to pay the price for 5 acers.

But, I suggest you to talk to any local lawyer for better understanding of the property structure.

If you are purchasing only 3.9 acres, then why pay for 5 acres.

The original owner has to give away the said property to government by executing a registered gift deed to the government for the purpose of park or any other amenities to which this portion of property was allocated while approving the DC conversion of agricultural land to plotted property for residential or industrial purposes.

You may reject the purchase offer and seek refund of advance amount for this fraudulent act of giving only 3.9 acres for the price of 5 acres.

What is the betterment charges going to do with this?

The DC is a different subject to that of the allotment of space to park or parking space.

In fact the condition impose to convert the land into industrial/residential plots, that the said extent of land shall be allocated for the purpose of park or parking space.
