• Need help regarding suicide attempt case

Hello respected authorities, My name is Yogesh Yadav. I used to work for a MNC where many employees were getting forced to work with some unrealistic rules and regulations. There was a great deal of unrest in employees and many were leaving the jobs. Our department was knows as hell so to explain the intensity. I was one of the people who tried to raise the voice against all of this mayhem and decided to stand up.

As we decided to approach higher authorities from the company, I started getting threats. I was told that they will make my life hell and make me suffer even if I leave the company by ruining my reference call from another company. I thought it will not be that serious and everything will settle down after the higher authorities intervene to save the employees. However I was put on notice period by my company for one month and I was told they will closely monitor me. I was devastated. I found my future in jeopardy and went into depression.

After the one month was over where I completed my Notice period successfully by overachieving my targets and quality scores. Even then my notice period was extended for another 1 month without any notice period. I was still getting warnings and threats that they are capable of ruining my carrier forever. I panicked and attempted suicide in my office premises. My company paid the bill and asked me to take rest and be n sick leave.

On one occasion I found out that my company has taken away my medical reports from the hospital without my consent which I believe is a gross violation of my privacy (copy of the letter is with me). Also I was called for an unofficial meeting with company lawyer by my HR director. In this meeting I confessed that I do realise my actions were wrong but I wasn’t wrong in those circumstances. I made clear my intentions of joining back but company asked me to wait as they have to decide. In the same very meeting Company Lawyer threated me that even if I go to court then it don’t matter because they know exactly how to drag this case forever. He confessed that Lawyer agencies like him are hired only for mass layoffs and even 5% people goes to court then they can manage these cases in the same manner. He also told me that they are the ones who spoke to local Police station and asked them not to register my case unless something happened to me. I have this entire conversation recorded.

The only witness in my case who saw the threats I was getting also got sacked my company. He was terminated in the same manner as I was. He approached management for his problem and management suspended his and then terminated him as well.

Now the situation is, local Police is not taking my case, Company has terminated me and instead of reliving letter, they have provided me with termination letter which will make it impossible for me to find another job. Send a detailed Legal Notice to your company seeking a redressal of all your grievances.

If the notice fails to help, approach the office of the Labor Commissioner taking recourse to appropriately legal remedy under the labour law regime.

As regards to the Police Case, if your wife is not being lodged, asked to the Supt. of Police asking him to intervene in the matter and direct his subordinates to lodge a FIR. If this too doesn't helps, file a Complaint directly before the Magistrate under section 156(3).

Hello sir , I am astonished and shocked to hear that such kind of harrrasment prevails in the corporate world and the way they are boasting that they have control over the legal system .. I assure you, that company directors like these beg plea before magistrates for forgiveness .. Now the legal steps you need to take ;- lodge a police complaint of criminal threat and abetment to suicide .. If the local police is not co-operating report to higher police officials ... If still no action is taken , you have a legal remedy to directly file a complaint case in court , the court has a power to investigate the matter Itself and direct the police to lodge a FIR against the company directors ..

Please tell me the post on which you are working.

Additionally you may send a legal notice to the company for redressal of your grievances, and then additionally you may approach the police for lodging an FIR, if the police is not lodging an FIR a complaint under section 156(3) can be lodged directly.

If, you fall within the definition of workmen then you may also approach the labour court to challenge the wrongful termination.

Giving threats is punishable under section 504/506 of the Indian Penal Code. Forceful termination of an employee is a breach of contract. You can file a complaint against a company under section 200 of CRPC for the offence punishable under section 504/506 IPC. You can file a civil suit for compensation for forceful termination. According to Section 73 of the Contract Act, you can get compensation for that forceful termination on the basis that by forcefully terminating you company has breached the contract.

If you can prove that you company has intention to ruin your career by such forceful termination then you can claim huge compensation for that act. Fait treatment is a fundamental right under Article  21 of the constitution, therefore you are entitled to get compensation for that ill treatment.

The termination letter is to be seen for the reasons stated therein for this cause.

If you feel aggrieved over the manner your case has been handled by the company, you can first issue a legal notice to reinstate you failing which you can either aproach high court with a writ petition seeking the relief of re-reinstatement or proper relief instead of termination action which was done to ruin your future career.

You have been targeted or victimised by the employer for blowing the whistle

Well the suicide attempt by you was unnecessary, in fact this may go against you, hence dont raise the issue based on your suicidal attempt.
