• What type of legal case to be taken against corrupt doctor

Dear Sir,
I am describing an even happened with me in short. A doctor of Very esteemed Government Organisation had cheated with me. He had taken money from me for Test Charges in Government Organisation. The doctor took the money from me, who did not want to take it because of he is government servant where all tests are free. I have all proof against that doctor including audio recording and documents. I have been communicated with them for the past two years in the above mentioned matter.
But I have not yet received a satisfactory answer.
Suggest to going forward.

Its a fit case where you can file case before the consumer forum seeking damages and compensation.

Additionally you can lodge complaint against him with the MCI to initiate disciplinary proceeding.

Do note no criminal case of cheating will lie.

1) complain to the Dean of the hospital against the doctor

2) if no action is taken file RTI application as to what action has been taken on your complaint

The doctor has committed offence which is punishable under section 13 of the prevention of corruption act. In this situation you can file a complaint against him before the Vigilance department for initiating criminal proceeding against him.

If Vigilance department does not take any action on your complaint then you can proceed to register a complaint under section 200 of the code of criminal procedure, this complaint shall be filed before the magistrate of the first class of district Surat.

Thereafter magistrate sell direct investigating officer under section 156 subsection 3 of code of criminal procedure to file case against that doctor and also report the matter to the District judge. Special Court is constituted in each district presided by the additional session judge, to deal corruption cases which is punishable under Prevention of Corruption Act.

The audio recording and documents are relevant evidence against him. You should give a certificate in respect of audio recording, according to section 65b of the Indian Evidence Act when electronic evidence is being produced it should be followed by a certificate. In the said certificate you have to mention that on which device you have recorded his voice and whenever it is required by the court you will produce that device before the court. Then the court is bound to accept audio recording.

If you were aware that he being a government servant and not supposed to charge fees from you for consulting and other allied services you co;d ave taken up this issue long back

Even now you can refuse pay the charges he has demanded.

You can make a representation in writing to the hospital authorities about this and seek relief and remedial action on this.
