• RTI by police

Dear Sir...
3-4 days Back,got a call from other Area-Police Station(bani park area),doesnot comes under that Police Station,under which ,I am Located

And SHO Said to Come ,and Meet him,also Told him to Bring Laptop ,to Check Details

As ,while Asking that for What about it is?
He Said ,that Inquiry under RTI has to be done

But ,I am Confused ,that without any Search Warrant,how he can Call to Bring Laptop,
Also no Notice/nothing in Written Recieved to me

Also ,that area is very much away ,from where I live,and is other Police station ,out of my Area

So,Please Suggest me,What to Do?

Hello,

If now written communication has been received by you then you are not required to go to the police station.

Please do not worry until and unless you receive some written notification.

Under RTI the police is obliged to send the permissible information but under no circumstances it can investigate an offence unless a FIR is registered.

So first take information if the case and then visit the police.

If you are gir named accused PO person then apply for anticipatory bail first.

You should be issued notice by Police to record your statement if any FIR is registered against you

2) you are entitled to copy of complaint filed against you

3) you should carry your laptop only if written notice is issued to you

Hi

you should go to the police on a written notice/ intimation by the police , if there is a complaint against you, if any FIR or NC.you can be called a a witness too , but the police has to tell you what is the matter filed against you or the FIR related in which they need your statement.

If someone filed an RTI , you are not liable to appear before the police.

So find out if there is an FIR or NC filed against you in that Police station, if so appear before them for the investigation.

Get the help of a local lawyer before going to the Police.

This really can't be for RTI, as you've been advised. Please speak to the SHO and request him that you be tendered with a written notice of appearance, so that you may learn the purpose behind this move of his.

If there is any enquiry has been initiated against you then police officer must have a warrant or summon.  without having summon or warrant a police officer cannot initiate any proceeding under section 157 of the code of criminal procedure. Investigation is also a proceeding initiated under  the code of criminal procedure. You should avoid the direction of police officer unless and until he produced warrant or summon. The police officer can ask called to produce anything unless he got search warrant under section 93 of the code of criminal procedure

In this condition you have to pay for an application before the superintendent of police for taking appropriate action against him. If the superintendent of police does not act on your application then you can move the court under Section 200 of the code of criminal procedure for initiating proceeding against that police officer for the offence of criminal intimidation and breach of Duty. Calling of a person to produce a thing without search warrant is an offence punishable under prevention of corruption act
