Sir I have a home which I had bought 25 years ago from owner were two brothers, the one who sold me was not having power of attorney of land. I've a fear that lest they would have sold it to someone else after that. I've registry documents with kharij dakhil. What should I do. Presently I've possession on the property. Please guide.

Hi, if you have posession over the property then there is nothing to worry .. Also you can get it clearified at the Patwari office in the mutation register .. If there is your entry in mutation then you are the only owner of the land

1) take search in sub registrar office as to whether any sale deed or gift deed has been executed by seller in respect of your property

You do not have to worry about the same since you are in possession since last 25 years. Also if you want you can file a suit for declaration, declaring thereupon that you are the absolute owner of the land.

1. Obtain Encumbrance Certificate from the jurisdictional Sub-Registrar's Office for the property for 25 years and you will come to know from the EC of transactions and charges if at all created on the property, except your transaction for the property.

2. Since you are in possession of the property for more than 12 years, in addition to the documents you have for the property, you need not worry because the Adverse possession clause is in your favour.

What is your worry about the property when you have purchased the property by a registered sale deed?

The propeerty is under your possession and the revenue records are also transferred to yor name.

In case if it was sold to anyone after selling it to you, there would have been a claim in this regard within this 25 years.

Even otherwise if anyone claims it , let him go to the court because the property is under your possession.
