• Club maintenance

My question is...in my registry it is wrote that club membership wll b free against rs 90000/-..
know after 2 years they are asking for money in the name of club maintanance..
plz guide me what is there according to law..

Maintenance charges are to be paid generally, for a more concrete advise you may share all the documents with an advocate so that the advocate can peruse the language of the clause and can give you proper advise.

Your membership is free But builder can charge you towards club maintenance charges every month

Your agreement must be containing clause to that effect

Hi, the membership is for the usage of club .. The maintanance charges is for the maintanace of the property .. It is used by the residents , so who will make expenditure for its maintainance . The demand is legal and valid

1. Club membership and Club maintenance are two separate things. Just because club membership is free, does not imply that you cannot be charged maintenance.

2. If there is no clause regarding club maintenance fee then the same can be charged from you.

If the deed or agreement is silent on the issue of club membership or specify it to be free then it can't charge any fees later on unless flat owners freely enter into any agreement with regard thereto.

In your case you can refuse to make such payment. If they penalise you for this you can consider to file case before the consumer forum.
