• Income limit to purchase agriculture land in Karnataka

Dear Sir/ Madam,

If the income limit is more than 25 lakhs per annum, is there a restriction to purchase agriculture land?? What is the legal remedy in this case please??

Yes. Section 79A of the Karnataka Land Reforms Act prohibits purchase of agricultural land by any person or family who have annual income of more than RS. 25 lacs from non agricultural sources.

The only way you may overcome this is by challenging the vires of this particular provision of the Act in the Karnataka High Court.

A. As per the Land Reforms Act, 1963 and its new amendments unequivocally stated that to purchase agricultural property that buyer income shall not exceed more than 25 Lakh from the other than agricultural sources. However, you can purchase this property after the conversion of the property from the agricultural to non-agricultural purpose if you want to purchase the same land under same income.

B. In my opinion, you are completely barred to purchase agricultural land as per the said Act. The Government will be confiscated the property if violated this provision.

There has been restrictions on purchase of agricultural land by non farmers in many states like in Karnataka.

So if you surpass the threshold limit you are ineligible to buy the land.

If you fragment the household income you may come under the eligibility criterion.

A person who or a family or a joint family which has been assessed to income tax on an yearly total income over 25 lakh rupees for consecutive 5 years from sources other than agricultural lands restricted to purchase agriculture land in KA.

After the bill (Karnataka Land Reforms (Amendment) Bill, 2015) the limit has been raised from 2 lakh to 25 lakh adn therefore in my opinion there is not legal way for you to purchase an agricultural land.
