My wife is sbi clerk and I am in merchant navy. My wife had a quarrelsome nature and she used to suspect each and every thing. She don't want to do house hold work and busy in taking tution after coming from work and not taking care of 7 month old daughter. Suddenly she started taking tution evening time 4 hrs and morning time 2 hrs. Initially we supported but we realised that she is not paying attention towards our infant daughter.we confronted her but she got so angry that she left though we did not handed over our infant daughter to her due to her wrong attitude and also our infant daughter was on bottle milk and my mother used to take care of infant daughter when my wife was working and also during her tution hour.later on her father came to take child saying that she will come back so we handed over baby to her mother and my inlaws. But after 2 days they started saying that we had mentally disturbed their daughter and she will not come back. Upon asking about baby they did not told location and stopped receiving calls. Can you please advice me how to proceed for child custody as I am having my permanent residance and joint family.

But she used to constantly neglect our daughter and totally dependent on us. Since birth my mother has been taking care of my daughter at our residance. Considering her bank job she would not be able to look after her child as my inlaws are living separate.
1) You can take the plea that mother is neglecting the child and in case she is awarded custody child would be neglected
2) Mention in your custody application that wife stays separate from her parents and there would be no one to look after child when she goes to work

1. You have to file a petition for child custody in the court. There is no alternative.
2. The courts seldom uproot a minor from the custody of his/her mother unless there is evidence forthcoming of a conduct that is unbecoming of a mother, but you will get visitation rights for sure. In a child custody petition the sole consideration for the court is welfare of child.
