I just came across a property which in Hyderabad for which BRS has been applied by owner under the govt scheme of regularisation as there are 3 floors additionally constructed than the approved plan. so My question is 1) Can such property be purchased as the owner is claiming soon it will be BRS approved as govt fee is paid. 2) He is claiming there is no requirement for OC as it is an independent house....is it?

1. It is advisable that you wait till the regularisation is done formally. That's because mere payment of compounding charges doesn't guarantees regularisation of illegal structure. The extra-contruction will be regularised only if this structure can be legally compounded in accordance with the compounding rules.
1.No constructions of permanent nature is permissible with the valid sanctioned plan.
2.If in this case any such amended plan is pending then wait for such sanction.
3.If it is a project done by a developer then getting of OC is compulsory.

if independent house comes under the area of municipality or development authority then OC is mandatory because it confirms that construction is in accordance to the norms set forth by the municipality or development authority.

You have to verify if the owner is coming under the category which makes him eligible for BRS and is it sure that he will get the benefits of the said scheme etc.
As a matter of fact since he has assured that he will get the approval, why dont you postpone the buying till he gets the approval, why do you want to rush or take a decision in haste by which you will get trapped in the problem in case his application is rejected.
