I got a call by a lawyer son of my junior colleague who threatened me of putting charges of mental torture under ipc 330 for stopping his pathologist father who works as a junior resident in surgery dept of a government medical college and who has zero knowledge of handeling surgery cases from mismanaging, mishandling, and doing wrong interventions in opd without consulting his seniors in surgery in this case its me as assistant professor and at present iam the only one who is senior in the dept. Tat junior resident has also used abusive language, threatened me for my life and living in gondia and filing police complaint just because i asked him to come in time, consult his seniors before advicing any treatment, refusing or referring the patient anx nt to do any intervention without seniors supervision. I have already forwarded a letter regarding this matter to the dean but no action has been taken so far. I do have the call recording of his lawyer son who without having any knowledge and concern wit the dept interfered and called me and threatened me tat iam doing mental torture to his father by asking him to learn and comply with rules for which he can file a litigation against me under sec330 for not allowing his father to play wit lives of pts. D Does any lawyer has right to call an unknown person and threaten him with such sections and allegations without any proof. What are my rights in this case both against the lawyer and his junior resident father the lawyer practices in dist court.

2) you can complain to the bar council against the lawyer

Hiii, section IPC 330 do not includes any of the above mentioned occurrences.. It has a complete different meaning .. I don't understand on which kind of logic his son is trying to implicate under 330 IPC which states:" voluntarily causing hurt to extort confession , or to compel restoration of property" .. 2) however threatning on phone is itself criminal offence under 506 IPC .. You can file a police complaint regarding it
If you have received a legal notice then it becomes yor duty to issue a reply notice to that denying all the allegations and also to warn the party concerned to not to adopt any illegal method to put pressure on you to stop any lawful action agaisnt him for his lapses.
