2. the crimes when under the garb of massage parlour sex racket is run therein.

1) it is only if a person keeps a brothel or allows the premises under his control to be used as a brothel that he commits an offence under section 3 of the act.

2)section 2(a) defines a 'brothel' as follows:'brothel' includes any house, room, conveyance or place or any portion of any house, room, conveyance or place ....

3)sec.4 relates to living on the earnings out of prostitution and sec.5 relates to procuring woman for prostitution.

4)you should apply for bail and wait for filing of charge sheet

5) then based on legal advice apply for quashing before HC

If the chargesheet has been filed, take your chance by way of challenging the same before the High Court. If the same is yet to be filed, you may challenge the FIR before the High Court. If the High Court does not grants you any relief, move an application for discharge before the Trial Court.
