According to Hindu marriage act the girl should be of 18 years and boy of 21.. You can have the engagement ceremony now, but marriage will be valid only when she will be a major ( 18 years)
Sir...its an issue of my good friend. He is a psu employee aged 25 and before 3 years his family decided a girl for him .both the families are ok with it and this year they are supposed to get engaged.but due to serious misunderstanding and different aspirations of both persons and family issues bridegroom wanted to call of marriage.but now the bride family are threatening that how can he leave the marriage proposal and marry someone else.and we won't let it happen??? Actually my friend is not ready to marry her due to emotional pain he had carried because of her and wanted to start fresh..so can't he marry someone with his own choice. Note:1.no engagement ceremony is done just words are exchanged between families before 2 years.
No formal engagement has taken place
Even if engaged boy is at liberty to call off the marriage
He can marry girl he wants to spend his life with
They cannot force you to marry under pressure and without your consent.. If there were no dowry articles exchanged, during engaged, they cannot take any legal action.. If they still force you, go and file a police complaint
IF just the words have been exchanged then he can go ahead and marry someone else, just beware of the fact that the family of the girl may raise some voice against such step, and in these kind of cases usually police is inclined towards the girl side.
Regards
1. The age of marriage for a female is 18 years, but it is not illegal to get engaged with a girl who is below 18 years.
2. Engagement does not bind you to marry the person you get engaged to. A promise to marry is not specifically enforceable. Girls and their families in India fume if the marriage is cancelled after engagement, and they ventilate their anger by filing false cases of rape and dowry demand. So this may be in store for your PSU friend/
Engagement ceremony cannot be even deemed to be a marriage between you two.
Hence the engagement ceremony cannot be an illegal activity just bcause she is 16 years old minor girl.
Cancelling the marriage proposal after the engagement is done is not an illegal act.
The boy are girl would have found incompatibility between them and either of them wold not be willing to carry forward this stigma lifelong hence there is nothing wrong in deciding to cancel the marriage proposal at this stage.
Generally the girl's side may feel that they would be insulted in the society if the marriage is stopped, hence hey would try to put pressure on the other side to somehow get the marriage solemnised, if they could not achieve, they may as a retaliation try to avenge them by filing false criminal cases, which of course may not stand in the court of law during trial.
