• Error in my date of birth in birth certificate

Hi,

My name in all my educational certificates is Anna Amrin and DOB is 12th Jan 1989 including passport, adhar and Pan where as my Birth certificate had the name as Anna Amrin and DOB 21st Jan 1989.
I recenty got my name corrected to Anam Amrin in my birth certificate but the guy who was making the corrections on my behalf did not make changes to my DOB which is still 21st Jan 1989 in my birth certificate. 

Please advice if getting my DOB changed in birth certificate is easier or getting it changed in all other documents including educational?

It will now be difficult to get the name change in educational mark sheet, high school and intermediate people will not do it easily. Fet it rectified in the birth certificate. If in the office of birth and death your date of birth is 12th then the correction will be done easily

1) what documentary evidence you have that your date of birth is 12th January 1989 ?

2) do you have the hospital discharge report which mentions your date of birth as 12th January 1989?

3) apply for rectification of DOB in BC . enclose copy of hospital discharge report that your date of birth is 12th January. A declaration signed by notary on stamp paper & state all the changes required.

4)also submit Driving License

- Passport/PAN Card

- Voter ID

- Ration Card

- Education Certificates/ School Leaving Certificate

which reflect your DOB as 12th January 1989

1. If you changed your name subsequently then change cannot be incorporated on the birth certificate as a birth certificate shows the status as it existed on the date on which the certificate was applied. Be that as it may, to change the DOB on your birth certificate you have to apply to the Registrar of Births and Deaths with an application for rectification of error. It is up to you to produce all the documentary evidence in support of the date which you want to be incorporated on the birth certificate. It is certainly not easy.

2. If you have the documentary evidence which can vouchsafe the date you want on your birth certificate, and yet the registrar does not rectify the error, you may seek court orders to this effect.

You cannot change your DOB to 21st January 1989 if actual DOB is 12 th January

2) it is better you obtain court orders for change of date of birth in school leaving certificate

3) apply to passport office to change your date of birth based on your birth certificate

You need to consult a local lawyer, and apart from going by procedure this has to be done through other means like contacting the concerned person and requesting him to do so.

It is easier to change the DOB in your other docs calculating the education ones than in your Birth Certificate.

Unless there is a discrepancy in your DOB as reflected in the birth certificate and the birth register, the DOB is not changed generally in the birth certificate.

If you still want to take a chance, file a writ petition in the High Court and seek direction against the Authority.

HI

1) Since your birth certificate carries the name of Anam Amrin and holds a date of birth of 21 Jan 1989, you can use the same to have all of your school certificate, PAN , Aadhar corrected to reflected as 21 Jan 1989.

2) It appears to be a typographical error which was not noticed by your school teacher's and parents and you can claim typographical error as rationale for the inadvertent error to creep in

3) You should

a) prepare an affidavit stating your date of birth as 21 Jan 1989,

b) Publish the date change requested in 1 english and 1 vernacular news paper,

c)Submit affidavit, news paper publications and Attested Birth certificate reflecting the DOB as 21 Jan 1989 to General administration department, Secretariat and

d) If all papers are in order, the GAD department will have the DOB and amendment there of published in the gazette thereafter.

4) Subsequent to publishing the gazette notification, Making changes to Date of birth will require you to apply to make separate applications to universities and authorities (X,Inter, University, Pan card, Aadhar and passport) by submitting

a) copies of birth certificate attested by a Gazetted officer,

b) copies of gazette published and get your date of birth corrected in all your records.

5) Unfortunately unlike name change which is a 3 step process, the date of birth correction in all of the academic and statutory records should be done for each certificate individually and is time consuming and will take about 30-45 days for publication in gazette and another 3 to 5 months thereafter for having the correct date of birth mentioned in all of your marks cards, Pan card and aadhar card.

You cannot change your original date of birth.

If you find error in the registration of date of birth in the register of births and deaths with the competent authority, then you may point out the error and get it rectified

You should ensure that which is the correct date of birth and and what are the documentary evidences to prove your correct date of birth, however you cannot change the correct date of birth in your educational certificate but you can make an affidavit on the basis of the correct date of birth that has been corrected by the authorities based on the substantial documentary evidences you produced before them, and keep this affidavit with the certificates to t clear the doubts that may arise in respect of your date of birth at a later stage anywhere.

You cannot change your date of birth to some false date other than the original date of birth.

The error in the certificates can be rectified except the school certificates.

You can, alternately, approach court with a declaratory suit to declare your correct date of birth as per birth certificate with a direction to the school authorities to correct the same in the educational authorities (which may not be possible at this stage)

or keep the court decree copy with the certificates so that this will clear all doubts and suspicion in this regard in future,
