• Cognizant not returning dues

Cognizant is yet to return the payment and the benefits inspite of proper resignation in 2012.After many harassments, in 2016, Cognizant agreed to pay after a legal case, but are not actually paying.Help!

1) if suit has been field to recover dues was decree passed for outstanding dues . kindly clarify

1. I woender why you were witing for such a long time.

2 Four years is indeed ai very long time.

3.Anyway if there is written communications stating arrears in your favour then they are bound to provide the same.

4. Since they are dilly dallying over this for no reason to expedite the payment you can seek both civil and criminal proceedings.

5.In civil proceeding money suit is an option while you can simultaneously file case of criminal breach of trust and cheating also.

You say that it 'agreed to pay after a legal case'. Was a decree or a compromise decree passed?

You can send them a legal notice, that in case of your failure to pay the dues you will be forced to file a contempt petition and also will bring the issue in media.

Hopefully, they will pay then.

If there is an order already against them in a legal case filed by you and they are still not complying with the order of the Court, file a contempt case against cognizant. However send them legal notice first calling upon them to be comply the order or otherwise you will be constrained to initiate contempt proceedings against them.

If there is a court judgment agaisnt the firm you may file a petition for contempt of court against the firm for not obeying the court order or you can file an execution petition to execute the decree for recovery of money by due process of law.
