• Reason for divorce file

Hello,

I got married in 2014 and it was only registry marriage.I stayed with my husband only for 3 days after marriage. I personally was not comfortable marrying him, but did it due to family's active and positive involvement. As I was not at all comfortable with him from the beginning, I could not stay with him more than 3 days after marriage.

Now, to file divorce I do not have any specific reason to give, but I am very much sure I can not stay with him. Please suggest what reason I should give so that I will not face any hindrance to successfully file and get the divorce.

It will be better and more convinient for you to convince your husband for mutual divorce .. If he agrees , then within 6 months divorce decree will be passed

Hello,

Talk to him if he is also agreeing to the divorce then you can go ahead and file a mutual consent divorce and if he not agreeing for the same then you can file divorce on the ground of desertion.

1. Mental incompatibility is no reason for divorce unless both aprties to it.

2.So you can approach your husband for mutual divorce in which case this reason is enough to apply for mutual divorce which takes six months of time.

3.If he does not agree for mutual divorce then you will have to file contested divorce suit on the ground of mental cruelty.

4.If your marriage is not consummated the suit for nullity is another option.

1. There are specified grounds based on which decree of divorce can be sought from the Court of law and one such ground commonly used in divorce cases is act of cruelty.

2. Without any specific reason and also without any reason acceptable by the law, no divorce decree will be passed.

3. It will be prudent on your part to negotiate with your husband and jointly file a mutual consent divorce for which incompatibility can be shown as the reason for seeking decree of divorce by both the parties.

4. Such MCD will be disposed of within 6 & 1/2 months from the date of its filing.

Since you state that you have not stayed with yor husband more than three days after marriage and it is over three years that you are not living together with him, you may ask him to give mutual consent divorce.

If he do not agree for this yo may file a petition for divorce under the grounds of desertion and mental cruelty by fabricating the documents so that you create a ground for divorce, let him challenge the same after which you can inform in the mediation about the reason and get divorced through the mediation session itself.

1.Convince your husband to file for mutual consent divorce which is hassle free and takes only 6 months as opposed to contested divorce which is a long drawn process with an uncertain result.

2. You really have no legal ground to file for divorce unilaterally, so better persuade him to come on board for mutual divorce.
