• Cheque bounce

Hi i am from hyderabad and i have issued few cheques in dheradoon which been bounced and later i been issued notice from my vendors about cheques bounce cases multiple. 
I have never attempted to attend dates given neither i been served any notices 
Though after few months i have settled payment by bank for all cheques issues 
But my vendors haven't cancelled the cases its still shows next date online 
My vendors through emaik acknowledged receiving of payments 
What do i do as all cases are still pending. 
How do i stop it .

In which court is the case pending?

Since 138 proceedings happens to be a compoundable offence, so you along with the vendor will have to mark appearance before the court, herein the vendor will undertake to withdraw the case.

1)the consent terms should have been filed in court then only payment made

2) request complainant to with draw the cases

3) if he fails to do so appear in court and place on record that full payment has been made by you

1. It is no clear whether you made payments after filing of the case or beofre it.

2. if you have repaid by paying within the statutory time limit of 15 days fromthe date of receipt of demand notice then you can apply for discharge in the case after your appearance.

3. If not then your payment is not enough to end the case and you will have to face full trial of the case.

You should have paid the amount in the court directly .. However you can appear before court and show the Payment receipts .. It is a bailabe offence , so u need not worry.. If you don't appear city will issue warrant of arrest .. For detail consultation of procedure kindly consult via phone

Your vendor who is compliant to cheque bounce cases have to withdraw the complaints by filing 257 CrPC petition as he has already received the amount of cheques which are subject of of cases. The cases can also be settled before concerned LOK-ADALATH by appearing both you and your vendor. If in case, your vendor did not withdrawn the case, you have to submit the cheque payments details made to your vendor before the Hon'ble Court after perusing payment details and considering facts the court will close the cases.

You can write to your vendors about this and ask them to withdraw the cheque bounce cases pending against you.

If they do not respond then you may either attend the case by appearing before the court and file a memo giving the documentary evidence for having cleared the cheque amount and request to absolve you from all charges, the court may pass conviction by imposing fine amount only.

Alternately you abstain from appearing in this case at Dehradun, even the complainant will not bother to follow up the case and it may get dismissed for default.
