• Identification by advocate for certified copies

We have filed CA form for certified copies as party-in person in family court, it was returned citing identification by advocate is needed. We don't want to appoint an advocate. We can get CA form identified by an advocate, will it be sufficient to write advocate's bar council registration number to prove his signature?(the reason we are asking this question is that court staff is not cooperating with us, not only in this issue) Can a notary identify a party in a CA form?

Hi

A Party in Person is eligible to apply for Copy application(Certified copies) of order in Family court.

Any advocate including a notary can identify the party in person and also sign the Copy Application form.

Any advocate not being a notary can also sign the identification column and provide his Bar council number.

Hope this information is useful.

1) CA form filed by you should be signed by advocate and it should be mentioned it is true copy

2) not necessary to mention his registration number

3) notary can identify party

For getting certified copies from court by party in person, the signature of the party has to identified by an advocate i.e. below signature of party an advocate has to sign by identified by me and for this purpose you no need to appoint any advocate. Just signature of advocate is enough, no need to appoint or file vakalatnama. You just submit a Copy Application as a party in person and identified by an advocate. You can approach coping Section Superintendent, if you are having any problem, because the court staff must cooperate with you.

It has to be certified by an advocate only and you can not get certified copy by merely writting the registration number of the advocate, it has to be signed by him.

A lawyer's name and registration number is going to be sufficient for pulling out the certified copy. rest you can collect on on the behalf of the said lawyer.
