• Claim amount wrongly awarded for land acquisition NH66 near Kota

There was a notice in 2011 against land acquisition from NH66. However we were not in town and did not act on it. But now got the information that claims have already been paid to 2 person. The survey number has 3 Hissas and mine is 1 Hissa, but when i approached NH authorities they say amount is already paid. I filed RTI and got the information on claims paid. RTC is in my name (32 cents) and 2 others (5.6 cents,0.5 cents). Authorities have wrongly paid to them. How do i claim in this situation? Whom to approach NHAI authorities or Court? If court which court?

1) filepolice complaint of cheating , forgery against persons to whom payment has been made

2) also complain to NHAI authorities that no payment has been received by you

3) if you are not paid the compensation amount by the authorities file writ petition in HC against NHAI to direct NHAI to pay you compensation for your land acquired

1. Send a legal notice to NHAI Authorities regarding non payment of compensation to you.

2. Based on the reply and if the reply is not in your favour, then approach the High Court and file writ petition against NHAI for compensation for acquisition of your land.

Sir/Madam, I suspect there were some forgery act by either neighbors of your land Or NHAI authorities. You have to approach the jurisdictional court for claim. I need to see the documents that you obtained through RTI against the claim.

You should first get a confirmation about the payment made by the authorities to a wrong person after that you should send a legal demand notice claiming your share of consideration amount from the authorities. If you dont get a proper reply then you may drag them to the court for payment of your dues as well as for injunction restraining them from proceeding until your amount is settled.

You are not at fault if they have settled your money to a wrong person.
