• Civil case at District Court Hubli

I have lost a civil case at district court Hubballi. The main reason being that 
a) My advocate was not that experienced and had not guided me properly in collecting the evidences.
b) The judge who heard my case is not the one who has given the judgement
 I want to go for an appeal at high court, Dharwad. Can you suggest me a good high court advocate who can present my case.The judgement has "Decree by Cost" please elaborate.

Dear Sir,

Some times it happens. Not to bother. If there is no sufficient evidence brought out and evidence was properly led then you have ample chances of getting remanded back the entire proceedings to the trial court for recording additional evidence. Without sharing the judgment it is impossible to say anything more. Further drafting of appeal memo is very important, get it drafted by experience and retired judge. You will succeed.

Decree by cost means that the suit is contested and the party has to bear the cost as mentioned in cost memo prepared by the court.

Further to get stay on lower court order First appeal before high court can be filed approach high court lawyer with all documents that is judgement copy of suit reply rejoinder and all documents the advocate can prepare first appeal and file same.
