• Compensation from Builder on for Low Quality of Flat Delivered

Hello,

I have bought a flat in Hyderabad around Nov - 2012. Recently I had to get minor plumbing and carpenter works done in the flat. Both the service providers had a negative feedback on the quality of construction. Walls could not take a minor drilling operations. Builder have probably have used more sand than required compromising the building quality. Can I get the quality of the flat checked by a certified agency and go legal and claim compensation from the builder regarding the quality of the flat delivered.

1. You should have got the flat inspected from an engineer before taking the possession. Now that you have taken possession without protest it will be an uphill task for you to prove that the builder used inferior quality materials. Overall, the prospects of any such claim after lapse of 4.5 years will be bleak.

2. Be that as it may, you can get the flat examined by a certified agency and then sue the builder for damages.

3) if substandard work has been done file complaint against builder and seek compensation

Yes you are entitled and can claim compensation from the builder for defects in the construction including plumbing and carpenter works and composition of quality. You get certificate from qualified engineer and have to send a legal notice to the builder narrating the defects in construction and to pay the compensation within stipulated time. If builder came forward for compensation it is well and good, if not you can claim compensation by approaching concerned consumer forum court.

Once you get a certificate or a report from a concerned expert or agency , end the builder a legal notice and file consumer complaint .

the quality of the construction is also of the safety , the builder had done it on the cost of your safety .

You can very well get the property inspected and have a detailed report from a qualified Engineer, have it verified with a second opinion from another expert Engineer, issue a legal notice to the builder and also drag him to a consumer forum for compensation and other reliefs.
