• Is marriage certificate from Las Vegas valid in India ?

Hi, I am an Indian (Nationality: Indian) and I am planning to get married to a Taiwanese girl (Nationality: Taiwanese) at Las Vegas. Would my marriage certificate from Las Vegas be valid in India?

1) you should register your marriage with Indian embassy or consulate under provisions of foreign marriage act in USA

1. if you are Indian citizen then marriage is valid in India.

2. It shall be registered in India but you have to publish a notice according to special marriage act before getting registration in India.

1. marriage certificate issued from concerned authority of Las Vegas is mandatory to prove solemnization of marriage. without it marriage cannot be registered in India.

If you would like to marry a foreigner in a foreign country you can contract the marriage under the special marriage act and can get your marriage solemnised in the nearest Indian consulate/High commissioner/Indian Embassy situated near you.

) the foreign marriage can be Registered under the Foreign Marriage Act,1969 in US(before the Indian High Commission and or before the Indian Consulate Generals Office as the case is)

Thank you for your reply. Did you mean after getting the marriage certificate from Las Vegas , on the basis of Las Vegas certificate I can register my marriage in India under special marriage act ?

You can get the marriage registered in India as per the provisions of special marriage act and complying with the procedures thereon.

In case a marriage between an Indian and a foreign national is to be registered in india , generally its required to file a notice of intended marriage with a Marriage Registrar in Bangalore . That notice is required to be published for the stipulated 30 days. At the end of the 30 days the Marriage Registrar is free to perform the marriage.

The notice of intended marriage can only be given in India, if at least one partner is permanently and the other partner temporarily resident in India.

After the stipulated waiting period of 30 days the marriage can take place in India. Under the Special Marriage Act, 1954 a certificate showing the signatures of the persons married, the registrar and the witnesses will be issued. This Certificate is required as proof of the marriage and when applying for a visa to for a foreign country.

The following documents are required for both the partners: a valid Passport, original Birth Certificate showing parents' names,

if the person concerned is widowed, the original death certificate of the deceased spouse

If divorced, copy of the final decree, documentary evidence regarding stay in India of the parties for more than 30 days (ration card or report from the concerned SHO)

2. If you marry in USA as per USA Marriage act, then the said marriage is not accepted in India as per Hindu Marriage Act or Special Marriage Act.

3. You can marry in India as per special Marriage Act (if she is not converted to Hinduism) or as per Hindu Marriage Act ( if she agrees to get converted to Hinduism) and get tye said marriage registered before the Indian Consulate.

4. You can alo get married as per Foreign Marriage Act in USA and get the said marriage registered before the appropriate officer of local Indian Consulate.

5. You can also get married by performing the Hindu rites and customs before the Arya Samaj temple or any other Hindu temple situated at USA and take a marriage certificate from the temple authorities (provided she is willing to get converted to Hinduism).

6. All such marriages conducted at USA will be treated as valid in India.

1. You can register your marriage as per Special Marriage Act in India or before the appropriate officer of local Indian Consulate.

2. The Marriage Certificate issued by USA Authority will be of no consequence here and will not be required to be submitted.
